Maltby Tank s Barge <br />Rezone 3-84 <br />Page -7- <br />CONCLUSIONS <br />1. The application is for the approval. of a rezone of <br />property located at the northwest corner of Lenora and <br />South First Avenue in the City of Everett, Washington, <br />and more particularly described as set forth above. <br />This specific rezone is from an R-2, Single Family High <br />Density Residential designation to a B-2, Community <br />Business with contract limiting the use to office and <br />residential use. <br />2. The property that is the subject of the rezone is a 1.3 <br />acre tract that is co -owned by three separate property <br />owners. <br />3. The City of Everett has recommended approval of the <br />rezone subject to the entrance of a Concomitant <br />Agreement with all three property owners. The <br />Concomitant Agreement sets forth the conditions for the <br />rezone and the development of the subject property. <br />4. The southern portion of the subject property will be <br />developed upon approval of the rezone. The other two <br />property owners on the northern portion of the site have <br />not expressed intents to develop at this time. <br />5. The requested rezone of all property is consistent with <br />the guidelines and standards for B-2, Community Business. <br />6. The subject property satisfies the purposes and <br />functions of the B-2 zone in that it provides and <br />protects certain areas within the City of Everett for <br />retail business and services. With the extention of the <br />Applicant's use of administrative offices and storage <br />yards, the proposed rezone will be in conformity with <br />the purposes of the B-2 zone. <br />7. The proposed rezone is consistent with the Comprehensive <br />Plans of the City of Everett and in particular the 1967 <br />designation as a transition area and the 1972 update as <br />an industrial area. . <br />8. The development of the parcels within the subject <br />property must be done by terms of a Concomitant <br />Agreement. Such agreements will allow for a reasonable <br />development of the properties as consistent with the <br />neighborhood in which the property is located. <br />
