Development of the subject property with a B-2 <br />designation will not be adverse to the surrounding uses <br />of the subject property. <br />10. The City of Everett has recommended approval of the <br />rezone subject to the formation of a Concomitant <br />Agreement between the three individual property owners <br />of the lands within the subject property. <br />RECOMMENDATION <br />Based upon the preceding Finding of Facts and Conclusions, the <br />testimony and evidence submitted at the public hearing and upon <br />the impressions of the Everett Hearing Examiner upon a site <br />view, it is hereby recommended to the Everett City Council that <br />the requested rezone of the property located at the northwest <br />corner of Lenora and South First Avenue in the City of Everett, <br />Washington, and more particularly described as set forth above, <br />be granted. The rezone is for the 1.3 acres and is a change <br />from a R-2, Single Family :sigh Density Residential designation, <br />to a'B-2, Community Business designation. This rezone should <br />be effective subject to the entry of a Concomitant Agreement <br />between all of the property owners and the City of Everett. A <br />copy of the proposed Concomitant Agreement for all three <br />property owners is attached hereto. <br />It is noted that there are changes from the original <br />Concomitant Agreements submitted at the public hearing. It is <br />recommended that the Everett City Council adopt the Concomitant <br />Agreements that have been revised by the Everett Hearing <br />Examiner. The changes of the Concomitant Agreements made by <br />the Everett Hearing Examiner are: <br />Section 1 (F) should read as follows: <br />F. The appearance of all commercial buildings will <br />generally conform to the historical theme portrayed by <br />the plans for the MTB office (Exhibit 5). A Design <br />Review Committee composed of the owners of the subject <br />property, an independent architect, and a representative <br />of the Lowell Civic Association or its successor, shall <br />review all building plans for all structures prior to <br />the submittal to the City to insure that they generally <br />conform to the design of MTB office building. <br />
