Diedrich; 920-84) <br />, Based upon the vrit��n request for a varSance from th� City's zoning <br />code, apecificallq EMC 19.16.030, made by Dennie V. Diedrich, hereinafter <br />referred to ae "Applicant," the Board of Adjuetment held a public hearing on <br />said application on September 10, 1984. Following said hearing, a motion vas <br />made and aeconded to grant ehe variance requeat. Board members Wilson anfl <br />Zook voted for the granting of the variance vhile board membere Miller and <br />Hoagland voted againet granting ehe variance. The basis for the board members <br />voting againe[ the granting of the variance ia ae f�l]ovs: <br />1. There are no eaceptional or extraordinary circumstancee or conditione <br />apglying to the subjec[ property or as to the Sntended uae thereof, <br />that do not apply generally to other properties in the same vicinity or <br />zone: <br />a. <br />b. <br />Findinge: <br />The Applicant ovne a parcel of property which ie located at 5512 <br />Sauth Pirst Street, Evarett. The Applicant'e property consieta <br />of a 6,000 aquare foot lot vt:ich is zoned R-2. 'fhe R-2 zone <br />allow eingle faaily reeidence� to be located oz 5,009 equare <br />foot lote aad duplexes to be located on 7,500 aquare foot lote <br />(EMC 19.16.030). The o[her lote in Applicant'e block have single <br />family reeidences on them. Applicant's property contaSne no <br />conditione euch ae eha�e or topographical location which are <br />unique to hia lot. Applicant ia eeeking a variance to allow a <br />duplex on a 6,000 equare foot lota. <br />The Applicant hae a eingle familq etruct��re on the sut <br />property vhich hae been comet:ed to a triplex and is curre <br />being used as a duplex. The convereione by the Applicant of <br />structure in queation took place rrlthout the required <br />permita. <br />Concluaione: <br />The Applicant's property doea not contain any physical conditione <br />or circumetances unique to hie property for which a variance can <br />be graneed. Applicant's current use ie in violation of the <br />City's zoning code. The only hardahip which the applicant hae <br />demonatrated is due to the fect that Ue now ia operating a duplex <br />etructure vhere such ie not permitT.ed unlesa Lhe Applicaat has a <br />lot of 7,500 square feet or larger. But thia cannot be <br />conaidered an exceptianal or extraordinary circ�matance becauae <br />the only reasan the Applicant ia in thia situation is [hat he has <br />not complied w7.th the City ordinances.
