Findinge: <br />The Applicant ia currently uaing the etructure located on his <br />property as a duplex etructure. Thie is a'aingle family dwelling <br />that haa been converted without the benefit of any permite or <br />having met any other City requirementa. The other atructurea in <br />hie area are predominately eingle family etructuzee. The <br />Applicant's lot is 6,000 equare feet in eize and there are <br />duplexee on 6,000 equare foot lots throughoct other areae of the <br />City. flowever, theae eaiat because they are non–conforming. <br />Other duplexea eaie[ in the vicinity of Applicant's property, but <br />thsee exiat on 7,500 aquare foot lots which is permitted. Single <br />family residences are permitted on 5,000 aqua.:e foot lots. <br />b. Conclueions: <br />The use to vhich the Applicant vanta to make of his property ia <br />not available to awnera of other property in the same zone or <br />vicinity. He can use his property for eingle family nee and will <br />be enjoqing the eame property rSgh[s posaessed by his neighbora <br />and othera eimilarly aituated. If he were allowed to uee it for <br />a duplex use, he would be enjoying a property right vhich those <br />in the same vicinitq or zoae do not have. <br />3. That the authorization of auch variance will be materially detrimeatal <br />to the public veSfare or injurioue to property in ehe vicinity or zone <br />in vhich the property ie located: <br />a. Pindinge: <br />Applicant'e lot containe only 6,000 equare feet. Due to the <br />emall size of the lot, there is inadequate apace for tenant <br />parking and for other tenant-related amenities which vould be <br />required of a duplex structure. <br />b• Conclueione: <br />The authorization of Applicanc's rariance for a duplex an a 6,000 <br />eqw►re foot lot in thie locattan would affect the peace and <br />tranquility of the neighborhood. There ia inadequate parking and <br />yard apace on Applicanc's property which rould result in placing <br />an undue burden on Applicant's neighbora and othera in the <br />vicinity of Applicant's property. <br />4. That the granting of euch variance will adversely affecC the <br />Cumpreheneive General Plan: — <br />a. Findinge: <br />According to the Comprehensive Plan, thie area ia deaignated <br />"single family." Permitted density within a eingle family area <br />is three to twelve unita per acre. Dcplexes oc; 6,000 square foot <br />lota conetltute a deneity of fifteen unita per acre. The new <br />aingle family comprehenaive policies atate that sinqle family <br />neighborhoods ahould be preserved and protected. <br />3sC <br />
