FINDINGS AND CONCLUSIO2:S
1. Shoreline Master Plan/Comprehensive Plan
Findings: A portion of the project is in an area that was annexed to
the City of Everett in 1986. Since the City Shoreline Master Program
has not been updated to include this area, the Snohomish County
Shoreline Management Master Program must be used for this area in the
interim. The Environmental Designation under the Snohomish County
Shoreline Master Program is "Rural," and utilities are permitted
subject to regulatory controls.
The City of Everett Shoreline Master Program designation for the
remainder of the project is Urban Undeveloped and Rural. Utilities
are permitted subject to general and specific regulations.
Conclusions: The use is consistent with the Shoreline Master Program
and all planning documents relating to the site.
2. Zoning
Findings: The buried cable will pass through the following zones:
R-2, Single Family High Density Residential; M-1, Heavy Manufacturing
zone; A-1, Agricultural Use zone; and FWD, Floodway District.
Conclusion: The utility use is permitted in these zones subject to
regulations.
3. Floodplain Regulations
Findings: The portion of the cable south of Lenora Street along the
Burlington Northern right-of-way and that portion east of the
railroad along the Lowell River Road are located in the 100-year
floodplain of the Snohomish River and are regulated by E.M.C. Chapter
19.11, Floodplain Regulations and Federal Flood Insurance Regulations
Title (24 CFR) Section 1910.3. The fiber optic cable will be buried
and so will not require protection from or restrict or obstruct the
flow of floodwaters.
Conclusion: -E.M.C. 19.11.040(C) and (D) permit utility transmission
lines subject to Conditional Use Regulations which will be
incorporated as part of this Shoreline Permit.
4. Environmental Impacts
Findings
Earth: Trenching to install the buried cable to a
depth of 42 inches with backfill to the
existing grade will be the only disturbance
to the earth. Public Works has reviewed and
approved ;letailed plans for installation.
Water: Burlington Northern Railroad right-of-way and
the Lowell River Road portions of the cable
route lie within the 100-year floodplain.
The fiber optic cable will be buried and so
will not require protection from or restrict
or obstruct the flow of floodwaters.
d=
