We apologize that wc were unable to adequately address your concems in our <br />previous corresponde�ce. It was rot our intent to "attempt to placate" you. We will endeavor to be <br />more specific with this response. <br />The permit applications for the three (3) single family residences were filed witli the City on July 2, <br />1996. On 7uly 11, 1996, !he Everett Planning Department detcrmined that a portion of the <br />properties contained an Environmentally Sensitive Arca (ESA), and required a protective covenant <br />be recorded against the property prior to issuance of the building permit. A legal description was <br />written by a professional land surveyor and recorded on July 31, 1996. The Building Permits were <br />issued on August 13, 1996. <br />Buffer reduction requests for an FSA aze administered by the Planning Pirector and require no <br />notification of area residerces. The 14 day appeal period is for the applicant, whose property <br />contains the ESn, to appea] the director's decision. <br />The builder has no authority to constnict the southern most home, 5610 S Third Avenue, closer than <br />twelve and one half feet (12'/z) to the center of the crcek. Initial inspection of the foundations <br />indicated that the builder would meet this requirement. The Planning Department will site inspect <br />the home prior to permit finalization to ensure the builder has met the requi�ement. <br />We are not famitiaz with the comparison you made between this pruject and the unnamed non-profit <br />project you mentioned. If ;�ou couid provide us with further detail, we could research the project to <br />determine the basis for the decision. <br />The City dces not enforce the pos6ng of residential building rermits and/or inspection records as a <br />matter of policy unril lhz structure is framed and there is a place to post the pennit out of the <br />weather. <br />The rieveloper was noi given approval to remove the Uees. However, single family residences are <br />permitted ;o remove trees along their aoutting right of way to gain driveway accesa ro the home.
