� � � <br /> BOARD OF ADJUSTl�NT <br /> FINDZNGS� CONCLUSIONS AND ORDER <br /> � � VARIANCE NO. 9-86 ) <br /> Based upon the written request for a variance from the City's zoning <br /> code, specifically E.M.C. 19.14.040, made by Fred and Mary Howe at 3116 ' <br /> Tulalip, hereinafter referred to as "Applicant", the i3oard of Ad�ustment, <br /> following a public hearing on said application held on April 4� 1986� and <br /> further having revieWed all testimony, makes the following Findings, <br /> Conclusions, and Order: <br /> Requested Action: A variance from E.M.C. 19.14.040, Gross Floor Area Ratio <br /> The Applicant is proposing to demolish and then reconstruct a nonconforming ' <br /> one-story single family residence. The existing structure is nonconforming as <br /> to north side yard setback which is five feet instead of the required six <br /> feet, front yard setback which is 13 ±'eet instead of the required 20 feet, and , <br /> lot size which is 4,500 sq. Fc. instead of the required 7,000 sq. ft. <br /> The applicant has applied for a Nonconforming Use Permit to allox the new <br /> structure to be rebuilt on the footprint of the old structure on the north, <br /> east and west. The buildiag would be extended seven feet to the south which <br /> would not increase the nonconformity of the bui2ding as related to front or <br /> side setbacks. A second story will be added, which along with the added seven <br /> feet to the south will increase square footage of the residence from existing <br /> 1,000 sq. ft. to 2,360 sq. ft. (1,480 �q. ft. on the first floor pius an 880 <br /> sq, ft. second floor). An existing 342 sq. ft. detached garage uill remain, � <br /> which along with the proposed 2,360 sq. ft. residence totals 2,�02 sq. ft. of <br /> gross floor area. Dividing the 2,702 sq. ft. by �::� 4,500 sq. ft. lot area <br /> gives a gross floor area ratio of .60 instead of the .30 ^lloved by code. <br /> FINDINGS AND CONCLUSIONS: <br /> 1. ThaL there have been exceptional or extraordinary circumstances or <br /> conditions applying to the sub�ect property or as to the intended use <br /> thereof that do not apply generally to other properties in the same <br /> vicinity or zone. <br /> F:.nding: The house is on a nonconforming lot of 4,500 sq. ft. <br /> in.atead of the 7,000 sq. ft. required by the current code. The <br /> applicant wishes to add a second story to take advantage of the view to , <br /> tba uest. The second story would be within the 35-foot height , <br /> permitted in the zone and it appaars that it would not block anyone's ' <br /> view. <br /> Conclusion: The size of the lot dietates the need for the variance. <br /> Ii <br /> Ii <br />
