23. The proposal is not contrary to any other provisions of the zoning ordinances of the <br />Ciry of Everett or other City, Siate, and Federal regulations. <br />FINDINGS FOR VARIANCES <br />24. Two variances frcm the Zoning Code requirements are requested for the site. They <br />are: <br />a. Building Setbacks: In the C-1 zone, church buildings are required to have a <br />10 foot setback from all property lines. The proposed expansion would be <br />constructed to the rear lot line and would not meet the rear setback standard <br />of 10 feet. <br />b. Variance to Maximum 25°� Expansion for Non-Conforming Building: Per the <br />Zoning Code, non-conforming bwldings are permitted a maximum expansion <br />of 25°r6 or the existing floor area. The proposed expansion represents 48°k of <br />the floor area of the existing church. <br />25. In order for a variance to be approved within the City of Everett, the criteria of EMC <br />19.41.130.0 must be satisfied. These criteria are: <br />The variance is necessary because of exceptional or extraordinary <br />circumstances regarding the size, shape, topography, or location of the <br />subject property; or the location of a pre�xistmg improvement on the subject <br />property that corHormed to the zoning code in effect when the improvement <br />was constructed. <br />b. The variance viill not be materially detrimental to the property in the area of <br />the subject property or to the City as a whole. <br />c. The variance will only grant the subject property the same general rights <br />enjoyed by other property in the same area and zone as the subject property. <br />d. The variance is the minimum necessary to allow the subject property the <br />general rights described in Criterion 3. <br />e. The granting of the variance is not inconsistent with the goals and policies of <br />the Everett General Pian. <br />f. The need for th9 requested variance is not the result of a self-created <br />hardship. <br />26. Tha church was developed on-site prior to the adoption of the existing Zoning Code. <br />Although it was developed on a small comer lot, at the time it was developed, it <br />satisfied all development and Zoning Code standards. Pursuant to the existing <br />Zoning Coda, a variance is needed for the proposed setbacks and to exceed the <br />maximum 25°r6 expansion limit. The history of the development of this propeRy is an <br />exlraordinary circumstance relating to the property that waRants the grant of the <br />variances. <br />5 <br />
