2. In order for an Expansion of a Non-Conforming Building Permit to be granted within <br />the City of Everett, the criteria of EMC 19.38.090 must be satisfied. ThPse criteria <br />have been identified in Finding of Fact #8. All of these criteria have been satisfied <br />as addressed in Findings #9 -#23. It is determined by the Hearing Examiner that <br />the criteria for the issuance of an Expansion of a Non-Conforming Building Permit <br />are satisfied and the pertnit should be granted. <br />3. In order for a variance to be granted within the City of Everett, the criteria of EMC <br />19.41.130.0 must be satisfied. These criteria have been identified in Finding #25. <br />All of these criteria have been satisfied as addressed in Findings #26 -#31. It is <br />determined by the Hearing Examiner that the variance criteria as set forth in EMC <br />19.41.130.0 are satisfied and the requested variances from the building setbacks <br />and the maximum 25°� expansion limit for non-conforming buildings should be <br />granted. <br />DECI I N <br />Based upon the preceding findings of facts and conclusions, testimony and evidence <br />submitted at the public hearing, and upon the impressions of the Hearing Examiner of a <br />site view, it is hereby ordered that the requested Expansion of a Non-Confonning Building <br />Permit to allow an addition of 2,166 square feet to an existing church at 2801 Virginia <br />Avenue, Everett, Washington, is allowed. Variances from the building setback <br />requireme�ts of the Everett Zoning Code and from the limitations from the expansion of a <br />non�onforming buildings of 25% ere granted. The Expansion of a Non-Conforming <br />Building Permit and the variances are granted subject to the following conditions: <br />1. A Building Permit must be obtained from the Building Department for the proposed <br />addition and remcdel. All work must adhere to the State Uniform Building Code. <br />2. If the total building square footage is greater than 3,Q00 square feet, the proposal <br />must adhere to the City Spnnklc+r Ordmance which requires a fire alarm and/or fire <br />suppression system. <br />3. Parking must be per City Zoning Code and City Design and Construction Standards <br />and Specifications. With a total seating capacity of 200 persons, a minimum of 40 <br />parking stalis is required. The Applicant has provided a written agreement with the <br />Snohomish County PUD authorizmg shared use of its parking lot on Hewitt and <br />Virginia Avenues. The agreement stipulates the number of stalls and the days and <br />hours of use. This agreement becomes part of these permits. <br />4. Landscaping must be provided per Section 35 of the Zoning Code. At a minimum <br />this must mclude the followmg: <br />a. A landscape strip a minimum of 10 feet wide must be provided along the <br />Califomia and Virginia frontages. This area shall be planted with Type III <br />landscaping. This requirement may be reduced if the Iocation of existing <br />improvements would prohibit compliance with this standard. <br />
