All fu,ure expansions of the Jail or Work Release facilities shall comply <br />with the SEPA review procedures, the City of Everett Special Property <br />Use Permit process, and all pertinent Fire and Building Codes. <br />27. That any major deviations other than ones which have been noted in this <br />report from either the approved site plan or the proposed use shall be <br />reviewed by the Planning Director to determine if additional Planning <br />Director to determine if additional hearings must be held. <br />28. That Items 3-6 and I 1 be withdrawn from consideration at this time and <br />be given final consideration by the Hearing Examiner at a second <br />hearing after the County's budget for funding these additional costs has <br />been established. <br />38. The Everett Planning Department submitted that their recommended <br />conditons 3, 4, 5, 6 and 11 should be withdrawn and not made part of the <br />condition of approval. They recommended that an additional hearing be held <br />by the Hearing Examiner on these items after the Applicant has received <br />i <br />budgetary approval to proceed with them. <br />C3� The Applicant testified that it is their intention to receive budgetary <br />approval for sewer, sidewalks, easements and retention ponds sometime in <br />O late summer. The Applicant agreed that an additional hearing should be held <br />for final determination of these items. <br />40. The Applicant agreed with the recommendations of the Everett Planning <br />Department. <br />41. No protests were filed and no opposition testimony was presented. <br />CONCLUSIONS <br />1. The application is for the approval of a Special Property Use Permit and <br />variance for property located at 3002 - 3018 Lombard, Everett, Washington, <br />and more particularly described as set forth above and for property located at <br />3015 Oakes, Everett, Washington, and more particularly described as set forth <br />above. <br />2. The specific application, is for a Special Property Use Permit for the <br />construction of a new Jail facility at the property identified as between 3002 <br />and 3018 Lombard. In addition, a variance is sought on this property in order <br />to construct the proposed Jail to exceed the 65' alloweJ in the C-1 zone. <br />3. The property located at 3002 - 3018 Lombard is zoned C-1 as established in <br />the Everett Zoning Code. <br />4. The Special Property Use Permit request for the property located at 3015 <br />Oakes is for the Work Release Facility. This property is zoned B-3. <br />5. Section 19.58.010(C) of the Everett Zoning Code requires that any <br />governmental or quasi -governm entaI activity, including construction of <br />buildings, requires a Special Property Use Permit prior to construction. <br />
