The Application is for the approval of a Special Property Use Permit for <br />property locater+ at 3002 to 3018 Lombard, Everett, Washington, and more <br />particularly described as set forth above and for property located at 3015 <br />Oakes, Everett, Washington, and more particularly described as set forth <br />above. <br />2. The specific application is for a Special Property Use Permit for the <br />construction of a new Jail facility at the property identified as between 3002 <br />and 3018 Lombard, Everett, Washington. A Special Property Use Permit is <br />requested for the property located at 3015 Oakes, Everett, for a Work <br />Release Facility. <br />3. The Lombard Street property is zoned C-1 as established in the Everett <br />Zoning Code and the Oakes property is zoned B-3. <br />4. Initial approval of the Special Property Use Permit was made by the Everett <br />City Council. Approval was made pursuant to findings of fact, conclusions <br />and recommendation of the Hearing Examiner dated July 16, 1982. <br />5. A condition of approval by the Everett City Council was that the Applicant <br />receive budgetary approval for sewer upgrading and Interceptor. Fees, <br />sidewalk improvements, easements and detention fund contributions. The <br />Applicant has received such approval. <br />6. Section 19.58.010(C) of the Everett Zoning Code sets forth that any quasi - <br />governmental activity, including construction of buildings, requires a Special <br />Property Use Permi: prior to construction. <br />7. Before a Special Property Use Permit can be granted within the City of <br />Everett, the requirements and guidelines as set forth in Section 19.58.010(B) <br />must be adhered to. These include: <br />1. The proposed use must be reasonably compatible with other uses and <br />potential uses within the general area in which the use is proposed to be <br />located; <br />2. The proposed use must not have serious adverse effect on the ecology <br />and/or environment of the community; and <br />3. The proposed use must serve the public convenience and necessity. <br />8. The proposed Jail structure will be compatible with the adjacent <br />governmental buildings and satisfies this requirement of Section 19.58.010(B). <br />9. With conditions, the proposed Jail structure will not have a serious adverse <br />effect on the ecology and/or environment of the community. This section of <br />19.58.010(B)is satisfied. <br />
