The Apllicant has indicated that it will adhere to all of the conditions for tte engineering and construction development of the site. 18. No adverse testimony was received in this matter. CONCLUSIONS 1. The application is for the approval of a Special Property Use Permit for the construction of Fire Station No. 2 and a new fire administration building. In addition, the request is for 48 parking spaces at the building, with 21 spaces being underground, 19 being on surface, and eight off of an existing alley. The project will also include installation of two undergroutd 1,000 gallon fuel tanks. 2. In order for a Special Property Use Permit to be issued with; ty of Everett, the criteria of EMC 19.58.010 must be satisfied. �.ith conditions, these criteria are satisfied. 3. The proposed use will be compatible with other uses and potential uses within the area in which the development is proposed. 4. The use will not have serious adverse effect on the ecology and/or environment of the community. 5. The use will serve the public convenience and necessity. DECISION Based upon the preceding findings of facts and conclusions, the testimony and evidence submitted at the public hearing and upon the impressions of the Everett Hearing Examiner of the site view, it is hereby ordered that the requested Special Property Use Permit for construction of Fire Station No. 2 and a new fire administration building, east of Rucker Avenue and south of 36th Street, is granted subject to the conditons as listed herein. In addition, the site can be developed with 48 parking stalls as shown on the attached site plan. Further, the Special Property Use Permit allows for the City approval for the installation of two underground 1,000 gallon fuel tanks. State certification and approval is required. All of the Special Property Use Permit is subject to the following conditions: 1. A Notice of Construction must be obtained from the Puget Sound Air Pollution control Agency for the installation of the underground fuel tanks. 2. The new fuel tanks must be registered with the Department of Ecology's Storage Tank Unit of the Hazardous Waste Program on a state notification form within 30 days of being put into service.
