Specific engineering requirements have been set forth in the staff <br />report. The Apllicant has indicated that it will adhere to all of the <br />conditions for tte engineering and construction development of the site. <br />18. No adverse testimony was received in this matter. <br />CONCLUSIONS <br />1. The application is for the approval of a Special Property Use Permit for <br />the construction of Fire Station No. 2 and a new fire administration <br />building. In addition, the request is for 48 parking spaces at the <br />building, with 21 spaces being underground, 19 being on surface, and <br />eight off of an existing alley. The project will also include <br />installation of two undergroutd 1,000 gallon fuel tanks. <br />2. In order for a Special Property Use Permit to be issued with; ty <br />of Everett, the criteria of EMC 19.58.010 must be satisfied. �.ith <br />conditions, these criteria are satisfied. <br />3. The proposed use will be compatible with other uses and potential uses <br />within the area in which the development is proposed. <br />4. The use will not have serious adverse effect on the ecology and/or <br />environment of the community. <br />5. The use will serve the public convenience and necessity. <br />DECISION <br />Based upon the preceding findings of facts and conclusions, the testimony and <br />evidence submitted at the public hearing and upon the impressions of the <br />Everett Hearing Examiner of the site view, it is hereby ordered that the <br />requested Special Property Use Permit for construction of Fire Station No. 2 <br />and a new fire administration building, east of Rucker Avenue and south of <br />36th Street, is granted subject to the conditons as listed herein. In <br />addition, the site can be developed with 48 parking stalls as shown on the <br />attached site plan. Further, the Special Property Use Permit allows for the <br />City approval for the installation of two underground 1,000 gallon fuel <br />tanks. State certification and approval is required. All of the Special <br />Property Use Permit is subject to the following conditions: <br />1. A Notice of Construction must be obtained from the Puget Sound Air <br />Pollution control Agency for the installation of the underground fuel <br />tanks. <br />2. The new fuel tanks must be registered with the Department of Ecology's <br />Storage Tank Unit of the Hazardous Waste Program on a state notification <br />form within 30 days of being put into service. The notification form <br />can be obtained by calling .1-800-826-7716. <br />
