A landscape strip a minimum of five (5) feet wide must be provided along the parking <br />garage's interior lot line which abuts the Physicians Eye Clinic. This area shall be planted <br />with Type III landscaping. <br />f) The Planning Director may, using Review Process I, authorize a reduced width of <br />planting or waive some or all of the landscaping requirements per Section 35.070 of the <br />Everett Municipal Code. The applicant must submit a landscape modification request to <br />waive or modify the interior lot line landscaping requirements. <br />g) A minimum of 383 square fee of landscaping shall be provided in the interior of the <br />parking lot for the 22 parking stalls on the adjacent property. Landscaping must be <br />provided per Section 35.080E of the Zoning Code. <br />h) Prior to issuance of any permits, landscaping plans must be reviewed and approved by <br />the Planning Department per Section 35.100 of the Zoning Code. The landscaping plan <br />roust show location and dimensions of required vegetated swales, wetponds, detention <br />ponds, rockeries and retaining walls, and grading at 2 foot intervals. Irrigation systems <br />musts be provided in all landscaped areas per Section 35.130 of the Zoning Code. A 2-year <br />maintenance assurance device must be provided for the landscaping per Section 35.1308 of <br />the Zoning Code. <br />29. The applicant has submitted a petition to the City of Everett to vacate a portion of the alley <br />south of 39th Street, west of Hoyt Avenue and east of Rucker Avenue. The City's Real <br />Estate Committee has reviewed this proposal and they recommend approval of the vacation <br />subject to the following conditions: <br />• Payment of the Appraisal Fee <br />• Retention of a utility easement over the area proposed for vacation, or utility providers (City <br />of Everett Sewer Dept., Snohomish County PUD, and GTE) will need to be satisfied so that <br />they withdraw their requests for the retention of utility easements. <br />• Dedication of property to the City to create an "L" shaped alley as described- "the North <br />half of Lot 24, and th. South 11.5 feet of Lot 25, Block 5 in Climax Land Company's First <br />Addition to Everett, according to the plat recorded in Volume 4 of Plats, Page 21, records <br />of Snohomish County, Washington. Situated in Section 30, Township 29 North, Range 5 <br />East, W.M., County of Snohomish, State of Washington." <br />• Payment of 1/2 of the Appraised Value of the vacated property within 90 days of the <br />passage of the Vacation Ordinance. <br />30. Prior to any development activity occurring on the proposed project site or the issuance of <br />any Public Works and Building Permits for both on -site or off -site construction activities, <br />the City Council must adopt an ordinance approving the proposed alley vacation. The <br />applicant must also meet all the conditions of approval as required by the City Council. <br />31. For the proposed medic,! office building in the B-2 Zone minimum building setbacks must <br />ten (10) feet rear yard c hen not abutting an improved public alley. <br />32. For the proposed parking garage in the R-4, C-O zone minimum building setbacks are ten <br />(10) feet front, ten (10) feet comer, and five (5) feet interior. <br />
