Rodney and Patsy Heycs has applicd far a building pertnit for construction of <br />a 10 unit nparlmcnt complex, City of Everett SEPAN No. 99-OGI, located wcst o( <br />Rucker at 4004 to 4008 Rucker, Everett, WA, and more particularly described as follows: <br />Lega! Deseription <br />SMYTH LAND CO. 2N� ADDITION, VOL. 4, PAGE 25, <br />LOTS 4G, 47, 48 & 49 SNO. CO. <br />E3. The State Environmental Policy Act ("SEPA") provides processes and <br />rrocedures whcrcby major actions by state end locel agencics, including, 6u1 not limited <br />to, the issuance of building pertnits, may bc reviewcd to detemiine the nature and exlcnt <br />of thcir impact on the environment. Impacts on public scrvices, including scltools, ure <br />cnvironmental impacts Corpu�poses o(SEPA. SEPA rcquircs the miligntion o(advcrsc <br />cnvironmcnlal impacts. <br />C. 7 he Project will be Ixated in an area whcre the District will serve schooi <br />children residing therein. <br />D. Thc District has identified the impacls on ihc District ihat will be a dircct <br />result of the constmction af thc Pmjcct. <br />E. The identified impacts include the projected addition of 1,09 unhoused <br />cicmcntary nnd middlc school studenls to thc District. <br />I�. The District projecis that Ihe elementury school serving Uie Project will be <br />over capacity when thc studenls from the Project enter school. As a:esult, ihe District <br />���ill havc to provide space in portable classrooms and othcr school facililics in order ro <br />housc and o�hcrwisc accommodatc thcsc sludcnts. <br />G. Owner and Ihe District havc reviewcd the miligation mcesures reasonably <br />nccessary to mitigate the impacts directly resulting from thc Project and have concluded <br />�Iml the provisions sel focth below in this Agreement constitute complete and appropriate <br />provisions for (ull mitigation by Owncr of thc idcntificd impacts from lhc Projcct on thc <br />Dislrict. <br />Fl. Ncither the impacts idcntified nor the miligation measures offercd hcrcin <br />affect, reducc or cnlarge any othcr obligation Rodney and Patsy Hayes or the Projcct has <br />to comply with rcquircd land usc approvals. <br />
