-3- <br />Legal Descript�.on: Lots G& 7, �lock 5, Priday's First: <br />Addition. <br />Zoning: R-9 Multiple Family High Density Resi- <br />dence, <br />Mr. Brethauer spoke on behalf of his application. He stated <br />that he wished to replace an old roof mounted sign wit.h a <br />pole sign to upgrade his business and provide better identi- <br />fication of his store. He siated that the sign would be <br />tlie same size and same height as the existing sign and would <br />projecL- no more than three feet over public property. There <br />were no questions or cemments from the audience. <br />After visually viewiny tlie subject property and consi.dering <br />the facts presented, iL- was moved by Idr. IIaird and seconded <br />by hir. Berg and unanimously carried to grant this request for <br />the following reasons: <br />1. That there are ea:ceptional circumstancee or con- <br />ditions applying to the subject property that <br />do not apply to other properties in the same <br />vicinity or zone, specifically that this is a <br />legal non-conforming use, wishing to improve its <br />appearance by replacing an older sign. <br />2. That such vari.ance is necessary for thc preser- <br />'�ati.on and enjoyment of a substantial property <br />right of the appellant possessed by the own=rs <br />of other. properties i.n the same vicini'�y, <br />specifically that as a non-conforming •ase, the <br />applicant, while wishing to continue his operation <br />as is liis right, desi.res to enhance his firms iden- <br />tifi.cation by installiiig a more visible sign. <br />3. That tl�� authorization of such variance �oill not <br />be matcrially detrimertal to the puUlic welfare <br />or injurious to prop•=.rty in the vicinity, <br />specifically that thc majority of uses adjacent <br />to this property are no;�-residential and the <br />street i.s a hcavily travelled, well••lighted arterial. <br />The addition of this ,i.gn will not have a siynifi- <br />cant e:-fer_t on this situation. <br />9. That the gi.:ntiny of the vari.ance will not adversely <br />a`fect the comprchensi.ve plan_ <br />7n granting this request ihe IIoard imposed the follocving stipu- <br />lations: <br />1. That the base of the pole sign shall be located <br />entirely on private property. <br />2. That the sign shall not excecd thc heiqht or size <br />of i.he existiny sign (32 squarc feet). <br />
