the driveway located upon Grantor's property shall be restored to <br />its original or better condition, including the relocation of <br />stairway access structures now serving the Grantor's property, which <br />relocation of stairway access structures will be, likewise, at the <br />sole expense of the Grantee, and said structure shall be returned at <br />the expiration of the term of this agreement in at least as good <br />condition as such stairway structures are now found or built as of <br />the date of this agreement. <br />6.0 Indemnity: Grantee agrees to save harmless the Grantors <br />from the claims of third parties which may result as a result of the <br />negligent conduct of the Grantee, its contractor or agents, occuring <br />during the term hereof, which negligence approximately causes <br />injury, damage or harm to persons or property. Grantee agrees to <br />defend, at their expense, any lawsuits or causes of action which may <br />be brought by third parties predicated upon such theory of negli- <br />gence and to pay all attorney fees and court costs incurred with <br />respect to such claims or actions in the event of any final judgment <br />being entered as result of such negligence as herein described. <br />Further, the Grantee agrees to keep Grantor's premises <br />free from any claim of liens and to promptly pay its contractor or <br />agents for all services rendered in the construction, maintenance <br />and restoration of Grantor's premises as hereinabove provided. <br />IN WITNESS WHEREOF the undersigned have affixed their signa- <br />tures hereto this j91n day of , 1979. <br />GRANTORS: <br />(a) Owner or Landlord WILLIAM L.
