! <br />Report to City Council <br />September 14, 1988 <br />Page 2 <br />The Hulets moved into the building and then came to the City on <br />January 22, 1988, to apply for a business license to operate an <br />art gallery at this address. At that time they were told that <br />retail sales were not a permitted use in the R-5 zone. They <br />then leased the buildinq at the corner of Colby and Everett <br />Avenues and opened their art gallery, Artful Nuance, at that <br />location (see Exhibit 5). <br />On February 5, 1988, they applied for and were granted a Home <br />Occupatioi� permit to do their art work at this address, but with <br />nc retail sales at this address (see Exhibit 6). <br />Some time in February 1988 an application for a Use Permit for <br />1710 32nd that was partially filled out by Kathleen Hulet was <br />dropped off at the Planning office by Snohomish County-Camano <br />Board of Realtors. Since the application was incomplete and no <br />fae was submitted, no action was taken by the City (see Exhibit <br />7). <br />3201 Wetmore: This structure was constructed as a single family <br />residence and used as such until purchased by 5nohomish <br />County-Camano Board of Realtors in November of 1986, after which <br />they began to use it as an office. <br />On February 3, 1987, the Snohomish County-Camano Board of <br />Realtors applied for a business license and on February 13, <br />1987, the �ity sent them a letter requesting that they apply for <br />a Use Permit (see Exhibit 8). <br />A Use Permit is required by the City when a proposed use is a <br />permitted use in the zone but the building was constructed for <br />residential purpose. The reason for this requirement is that <br />the residential uses have a much lower parking requirement than <br />a commercial use and because a residential structure may not <br />meet Uniform Building Code (UBC) requirements for commercial <br />structures. The applicant for a TJse Pernit must provide parking <br />to code for the use proposed and also obtain a H��ilding Permit <br />in order to show that the construction meets UI:�. requirements <br />for the particular use. <br />The City did not receive a response from Snohomi-h County-Camano <br />Board of Realtors to the request that they apply for a Use <br />Permit and another letter was sent to them from the City on <br />October 10, 1987, again requesting that they submit an <br />
