PORT OF EVERETT SECTION 00800 <br />UNION SLOUGH MARSH MITIGAT[ON SUPPLEMENTARY CONDITIONS � <br />b. COIV7'R '►CI'OR shall furnish a payment bond in an amount at kast equal to thc ; <br />Cort�act Price (unkss otherwise provided) as security for the faithful performance � <br />of all CONTRACTOR's obGgations under the Procurement Documents. This ' <br />bond shall remain in effect at kast until one year after the date of fmal payment, <br />except as otherwise provided by law. <br />„ <br />10. Permits <br />Artick 6.13 of the General Conditions is amended to include the following: '� <br />The PORT has obtained approval under a Nationwide Permit from the Corps of Engineers <br />and a HydrauGc Project Approval from the Washington State Depar[ment of Fisheries. A <br />Shoreline Substantial Development Pemtit is � required for project. Thc <br />CONTRACTOR shall comply with all conditions of these permits. Copies of all pemuts <br />must be posted at the Contractor's project field office. <br />I 1. Increased Ouantities <br />Delete Paragraph 11.10 in its entirety and insert the following in its place: ' <br />"11.10 The PORT reserves the right to increase tho quantity of any item or portion of the <br />work or to omit portions of the work; also to make such altaations or deviations, <br />additions to, or omissions from the plans and specifications as may be determined - <br />during the progress of the work to be necessary and advisabk for the proper _ <br />completion thereo£ There shall be no renegotiation of unit price based on <br />overruns of individual bid items unless the total original Contract bid items to be <br />renegotiated increases by at least thirty percent (30�Yo). A renegotiation of a unit <br />price shall occur only on that item which is increased more than thirty percent <br />(30%). <br />If both the above conditions occur, the unit price for the estimated arraunt shall <br />remain as set forth in the bid proposal and additional lesser price upon the demand � <br />of either the PORT or the CONTRACCOR. A unit piice increase may be allowed - <br />only if the CONTRACCOR can satisfactorily dertanshate and documant that the <br />increase in the said quantiry resulted in the CONTRACTOR's increas�d cost in � <br />providing the said item, over the above that cost incucred in providing the �� <br />estimated quantity of the bid item Any renegotiatal price shall only accou nt for <br />the demonstrated increased cost in providing the increased quantity. <br />A decrease in unit cost for that amount in addition to the est'unated quantity shall ; <br />be allowed only if the PORT establishes that the unit ec,st for euch additional , <br />quantities was less than tho unit cost for the estimat� quantit�. - <br />[I:IEiI:I� <br />
