They rr�ay be altered or�y �y, a M��ation. <br />3•2 The Contract Documents are compkmentary; what is called for by one is as yinding as if called <br />for by all. If, during the perfotmance of the Worl�, CONTRqCTpR 6nds a conflict, er.or or <br />discrepancy in the Contract Documents, he shall repon it to ENGINEER in writing at once and <br />before proceeding with the Work affected theroby, however, CON'i'RpCTpR shall not be liabk to <br />PORT for failure to rcport any conflict, eRor or discrepancy in the Speci�C���ons <br />or Drawings unless CONTRACTOR had actual knowkdge theroof or should reasonably have known <br />thereof. <br />3.3 It is the intent of the Specifications and Drawings to describe a compkte project (or part thereo� <br />to be constructed in accordarn;e with the Contract Documentc. Any Work that rt�ay reasonably be <br />inferrcd from the Speci6cations or Drawings as being rcyuired to produce the intended result shall be <br />supplied whether or not it is sperifical�y called fo�, Wh�n words which have a well-known technical <br />or ;rade meaning are used to describe Work, materialc or equipment such words shall be incerpraed <br />in accordance with such meaning, Refercnce to standard specifications, manuals or codes of any <br />technical socicty, organization or association, or to the code of any govemrtkntal authority, whether <br />such reference be specific or by implication, shall mean the latest standard speci6cation, manual or <br />code in effect at the time of opening of gids (or, on the e�'ective date of the Agreement if there were <br />no Bids), except as may be otherwise specifically stated. However, no provision ot any rekrenced <br />standard specification, manual or code (whether or not spe�ifically incorporated by reference in the <br />Contract Documents) shall change the duties and responsibilities of PORT or CONTRAC('OR, or <br />any of the'v agents or err�loyas from those sec forth in the Contract Documents. Clarifications and <br />interpretations of the Contract Documents shall be issued by ENGINEER as provided for in <br />paragraph 9.2. <br />3.4 The Contract Documents will be governed by the !ew of the place of the Project. <br />Reuse of Docurr�ntc• <br />3.5 Neither CONTRACTOR nor any Subcontractor, manufacturer, fabricator, supplier or distributor <br />shall have or acquire any title to or ownership rights in any of the Drawings, Specifications or other <br />documents (or copies of any thereo� prepared by or bearing the seal of ENGINEER; and they shall <br />not reuse any of them on extensions of the Project ot any other project without written consent of <br />PORT and ENGiNEER and specific written verification or adaptation by ENGINEER. <br />END ARTICLE 3 <br />� <br />� <br />
