PORT OF EVERETT SECTION 00700 <br />UMON SLOUGH �fARSH MITIGP.'^ON GENERAL CONDITIONS <br />ARTICLE 4- AVAILABILITY OF LANDS; PHYSICAL CONDTfIONS; REFERENCE POINTS <br />4.1 PORT shall fumish, as indicated in the Contract Documents, the lands, upon which the Work is to <br />be pertumxd, rights-of-way for access thereto, and such other lands which are designated for the use <br />of CONTRACI'OR. Easements for pamanent structures or perrtvnent changes in ezisting facilities <br />will be obtai�xd and paid for by PORT, uNess otherwise provided in the Contract Documents. If <br />CONTRACCOR believes that any dday in PpRTs furnishing these lands or easements entitks him to <br />an extension of the Convact Time, CONTRA('►'pR may make a cLim tt�aefor as provided in Anick <br />12. CON'1'EtqCTOR shall pruvide for all additional lands and access thereto that may be required for <br />temporary conswction facilities or storage of materials and equiprtient. <br />Phvsical Conditions - vesti�fltions a� Reoorts• <br />4.2 Reference is made ro 3uppkmentary Condition 5 for identi5cation of those reports of <br />investigations and tests of subsurface and latent physical conditions at the si, � or otherwise affecting <br />cost, progress or perfont�ance of the Worlc which have been relied upon by ENGQVEER in <br />prepazation of the Drawings and Spec�.6cadons. Such repons are not guaranteed as to accuracy or <br />compkteness and aze not part of the Contract Docume�ts. <br />Unforeseen Phvsic� c'���rs��c• <br />4.3 CONTRACi'OR shall pror►�tly notify PORT and ENGINEER in writing of any subsurfaa or <br />latent physical conditions at tl�e site or in an existing swcture differing materially from those <br />indicated or referred to in the Contract Documents. ENGINEER will promptly review those <br />conditions. If ENGINEER finds that there are subsurface or latent physical conditions which differ <br />materially (rom thosc intended in the Contract Documents, ENGINEER will prepare a Change Order <br />incorporating modi5cations to plans and speci5cations as necessary to procad with and compkte the <br />Work. <br />Reference Point�/Suvevs• <br />4.4 PORT shall provide engineering survey infortnation and roferonce points for vertical and <br />horizontal control which in his judgment are necessary to enabk CONTRACI'OR to proceed with the <br />Work. CONTRACTOR shal! be rosponsibk for laying out the Work (unless otherwise spcci5ed in <br />the General Requirements), shall protxt and presecve the established rekrence points and shall make <br />no changes or relocations without the priot written approval of PORT. CONi'RACTOR shall report <br />to ENGINEER whenever any reference point is lost or destroyed or requires relocatit n bxa�se of <br />nuessary changes in grades or locations, and shall be responsibk for replacement o� relocztion of <br />such reference points by prokssionally quali6ed personneL <br />END ARTICLE 4 <br />00700-17 <br />
