No Worlc shall be delayed or postponed pending resoludon of any <br />disputes or disagrartx:nts, except as CON7'RACTOR and PORT may otlkrwise agrct in writing, <br />� � �r� �.. � , <br />6.30 To the fiilkst extent pertnitted by Iaw, CONTRACTOR shall indertrtify and hold hemJess <br />PORT and ENGINEER and their agents and employees from and against all clairt►c, damages, losses <br />and expenses including but not limited to attomeys' fas arising out of or resulting from the <br />perfom�ence of the Work, provided that eny such daut4 damage, loss or expense (a) is attributabk to <br />bodily injury, sicicness, disease or death, or to injury to or destruction of tangibk property (other than <br />the Work itsel� including the luss of use resulting therefrom and (b) is caused in whok or in part by <br />any negligent act or orttission of CONTRACTOR, any Subcontractor, anyone d'ua;Hy or indirecdy <br />employed by any of them or anyrone for whose acts any of them may be liable, ngardkss of wlxther <br />or not it is caused in part by a party indemni5ed hereunder. <br />6.31 In any and all claims against PORT or ENGIIVEER or any of their ageats or e�loytes by any <br />errq>loyee of CONTRACI'OR, any Subcontr�tor, anyone d'uocrly or indin�ctly employed by any of <br />them or anyone for whose acts any of them may be liabk, the indemni5catian obligatie� under <br />paragraph 6.30 shall not be limited in any way by any limitation on the amc unt or type of demages, <br />compensation or bene5ts pays,hk by or for CONTRACTOR or any Subcoatractor under worlcers' or <br />workmen's compensation acts, disability bene5t acts or other ert�loyee bene5t acts. <br />END ARTICLE 6 <br />00%00-Zg <br />
