PORT OF EVERETT <br />UMON SLOUGH MARSH MITIGATION <br />ARTICLE 9- ENGINEER'S STATUS DURING CONSTRUCTION <br />PORT's Representative: <br />SECTION 00700 <br />GENERAL CONDiTIONS <br />9.1 ENGINEER will be PORT'S �epresentative during tho conswction period. The FNGINEER <br />will be identified to the Contractor prior to comrtxncement of the work. <br />CL•vification� and Interprctations <br />9.2 ENGINEER will issue with reasonable promptness such written clarifications or interpretations <br />of the Contract Docurr.ents (in the form of Drawings or otherwise) as ENGINEER may determine <br />necessary, which shall be consistent with or reasonably inferable from the overall intent of the <br />Conaact Doc�ments. If CONTRACTOR beGeves that a written clari5cation or interpretation <br />justifies an inerease in the Contract Price or Contract Time, CON7'RACI'OR may make a claim <br />therefore as provided in Article 11 or Article 12. <br />Reiectine Defective Work• <br />93 ENGINEER will have authority to disapprove or reject Work which is defective, and will also <br />have authority to requfre special inspection or testing of the Work as provided in pazagraph 13.9, <br />whether or not tho Work is fabricated, installed or completed. <br />Shop Drawines. Chan¢e Orders and Pavments� <br />9.4 [n connection with Shop Drawings and samples, see paragraphs 6.23 through 6.28 inclusive. <br />9.5 In connection with Change Orders, see Articles 10, 11 and 12. <br />9.6 [n connection with AppGcations for Payment, etc., see Article 14. <br />Project Representation• <br />9.7 The PORT may designate a Resident Project Reprcsentative to assist ENGINEER u� observing <br />the perforr►�ance of the Work. The duties, responsibilities and limitations of authority of the Resident <br />Project Representative and assistants aze as provided in the Contract Documents. <br />Decisions on Disaereements• <br />9.8 ENGINEER will be the initial interpreter of the requirements o the Contract Documents a��d <br />judge of the acceptabiliry of the Work thereunder. Disputes relating ro the scceptability of the Work <br />or the interpretation of the requ'uements of the Contract Documents pertaining to the execution and <br />progress of the Work shall bc refeaed initially to ENGINEER in writing with a request for a fom�al <br />decision in accordance with this paragraph, �,vhich ENGINEER will render in writing within a <br />reasonable time. Written notice of cach such dispute shall be delivered by the clairnant w <br />ENGINEER and the other party to the Agreement within fiftan days of the occurrence of the event <br />giving rise thereto, and written supponing data will be submitted to ENGINEER and the other party <br />00700-31 <br />
