PORT OF EVERETT SECCIUN 00700 <br />UMON SLOUGH MARSH MITIGAT[ON GENERAL CONDITIONS <br />13.7 Neither observations by ENGQVEER nor inspections, tests or approvals by others shall relieve <br />CONTRACCOR from his obligations to perform the Work in accordance with thc �'�naact <br />Documents. <br />Uncovering Work: <br />13.8 If any Work is covered contrary to the written request of ENGINEER, it must, if requested by - <br />ENGINEER, be uncovera+ for ENGWEER's observation and replacxd at CONCRACTOR's expense. . <br />13.9 If ENGINEER considas it necessary or advisabk tfiat covered Work be observed by � <br />ENGINEER or inspected or tested by others, CONTRACI'OR, at ENGINEER': request, shali - <br />uncover, expose or otherwise make availabk fot obsorvation, inspection or testing as ENGINEER <br />may require, that portion of the Work in question, furnishing all necessary labor, material and <br />equipment. If it is found that such Work is defective, CONfRACTOR shall bear all the expenses of • <br />such uncovering, exposure, observation, inspection and testing and of satisfacmry reconsavction, <br />including compensation for additional professional services, and an appropriate deductive Change <br />Order shall be issued. If, however, such Work is not found to be defxtive, CONCRAC'COR shall be � <br />allowed an increase in the Convact Price or an extension of the Contract Time, or both, dircctly . <br />attributable to such uncovering, exposure, observation, inspe�tion, testing and reconstruction if he <br />makes a claim therefor as provided in Articles 11 and 12. � <br />PORT May StoQ the Work: <br />13.10 If the Work is defective, or CONTRACTOR faiLs to supply sufficient sidlled workmen or •- <br />suitable materiaLs or equipment, PORT may order CONTRACTOR to stop the �'York, or any portion _ <br />thereof, until the cause for such order has ban elimitiated; however, this right of PORT to stop the <br />Work shall not give rise to any dury on the part of PORT to exercise this right for the bene5t of <br />CON7'RACTOR or any other party. _. <br />Correction or Removal of Defective Work: <br />13.1 I If requ'ved by ENGINEER, CONTRACTOR shall prompdy, without cost to PORT and as <br />specified by ENGINEER, either correct any defective Worlc, whether or not fabricated, installed or <br />completed, or, if the Work has been rejected by ENGIIVEER, remove it from the site and replace it <br />with nondefective Work. <br />Acceutance of �efective Work: <br />13.12 If, instead of requiring correction or removal and replacement of defxtive Work, PORT (and, <br />prior to ENGINEER's recortvnendation of final payment, also ENGINEER) prefers to accept it, <br />PORT may do so.
