A substantial development is defined as a development <br />with lue which <br />which amateriall�ir market interferes with the ormalspublic00or use of anydevelopment <br />ve total water or <br />shorelines of tb� State of Washington (RCW 90.58.030(3)(E)). <br />7. The proposed development will occur along the shorelines of a <br />significant <br />shorelines, the withiny of water State <br />Pug t Sound, isprotected by the oWashington. <br />Shoreline Management <br />Act. <br />8, The City of Everett has administrative jurisdiction over the <br />shorelines <br />of Puget Sound within the City of Everett The Applicant <br />t secure a <br />horeline Management Substantial Development Permit from the City of <br />Everett. <br />9, The proposed development will have a total fair market value that will <br />exceed $2,500. The development will materially interfere with the <br />normal public use of the water and shorelines in this area. The <br />proposal is subject to review of the Shoreline Act of the State of <br />Washington. <br />10. The subject property is within the jurisdiction of the city <br />of ver ttwo <br />Shoreline Master Program. The subject property, approximately <br />acres, has a shoreline designation in the City of Everett Shoreline <br />Master Program as Urban Environment (Developed and Redeveloping). <br />11. The properties to the north, south, theand west east <br />Porte zoned Gardner M-2, • Heave <br />Manufacturing. The property to <br />properties to the north and south are developed with port facilities <br />w1nile the property directly to the east of the subject property <br />is he <br />DN Railroad. <br />12. EMC 20.12.070(A) establishes criteria for the issuance of aShoreline <br />Management Substantial Development Permit. The permit may <br />granted <br />when it is proven that the proposed development is consistent with: <br />A. The policies and procedures of the Shoreline Act <br />of 1971; <br />B. The Department of Ecology Shoreline Management <br />Guidelines of 1972; <br />C. The Everett Master Program; and <br />D. The Environmental Policy Act of the State of <br />Washington. <br />
