8 <br /> employees or from any loss or expense, claim or claims, action or actions, <br /> injuries or damages arising from the Contractor's employees when acting <br /> or allege to have arisen with their scope of employment whether on or off <br /> site; provided however, "scope of employment" shall include all acts of <br /> the employees which are directly or indirectly related to or arise from their <br /> employment. <br /> 3. Accounting <br /> a. The Contractor shall provide equipment and personnel for and perform all <br /> budgeting, bookkeeping and reporting services to the City for the courses. <br /> b. The Contractor shall, at all times, ensure that proper cash handling <br /> procedures and internal controls are in place to safeguard City assets. In <br /> addition, the Contractor shall comply with all accounting and auditing <br /> procedures and controls as may from time to time be directed by the City's <br /> Chief Financial Officer. <br /> c. Copies of all books and records shall be kept at the courses and shall <br /> remain the property of the City and shall be available for review by the <br /> City at reasonable times when requested by the City. <br /> d. All equipment, software, programs, manuals and the like related to the <br /> Contractor's operation regarding Point of Sale, accounting and electronic <br /> tee sheet systems will be the property of the City pursuant to any <br /> applicable licensing, use or purchase agreements. <br /> e. All data collected using Point of Sale, electronic tee sheet systems, and <br /> through websites shall be the property of the City. <br /> f. The Contractor must purchase a Point of Sale system that must be <br /> operational on the Effective Date. The system must be approved by the <br /> City prior to purchase. The City will reimburse the Contractor for the <br /> system as a Direct Cost. <br /> 4. Customer Relations <br /> a. The Contractor shall exhibit a thorough understanding of customers' <br /> wants, desires and value in an effort to provide quality service at the <br /> courses. <br /> b. The Contractor shall maintain customer service as a top priority. <br /> 4 9LV <br />
