7 <br /> 2007 STOP Violence Against Women Formula Grant <br /> Intergovernmental Agreement <br /> 6. FUNDING CONTINGENCY <br /> In the event funding from state, federal, or other sources is withdrawn, reduced, or <br /> limited in any way after the effective date of this Agreement and prior to normal <br /> completion, the Department may: <br /> • Unilaterally terminate this Agreement, or may reduce its scope of work and budget, <br /> without advance notice. If this Agreement is so terminate, the parties shall be liable <br /> only for performance rendered or costs incurred in accordance with the terms of the <br /> Agreement prior to the effective date of termination, <br /> • Renegotiate the terms of the Agreement under those new funding limitations and <br /> conditions, or <br /> • After a review of project expenditures and deliverable status, extend the end date of <br /> this Agreement and postpone deliverables or portions of deliverables. <br /> 7. AMENDMENTS <br /> This Agreement may be amended by mutual agreement of the parties. Such amendments <br /> shall not be binding unless they are in writing and signed by personnel authorized to bind <br /> each of the parties. <br /> The Department may, at any time,by written notification to the Contractor and without <br /> notice to any known guarantor or surety,make changes within the general scope of the <br /> services to be performed under this Agreement. All other modifications shall not be valid <br /> unless made in writing and signed by the parties. Any oral understandings and agreements <br /> not incorporated herein,unless made in writing and signed by the parties hereto, shall not be <br /> binding. <br /> Notwithstanding any provision of this Agreement to the contrary, at any time during the <br /> agreement period, the Department may analyze expenditures as a proportion of the <br /> agreement budget. If the Department determines, in its sole discretion, that the agreement <br /> funding is underutilized, the Depai tment,in its sole discretion,may unilaterally modify the <br /> Agreement to reduce the balance of the budget. Funds de-obligated by the Department as a <br /> result of a budget reduction may be made available to other contractors for the provision of <br /> eligible services. <br /> 8. REPORTS <br /> All community-based victim service agencies shall submit data quarterly in InfoNet. <br /> Law enforcement and prosecution contractors and subcontractors shall submit data twice <br /> on the report forms provided by the DEPARTMENT. Therefore, the CONTRACTOR <br /> will have more than one schedule for submitting reports. <br /> 28 <br /> Page 4 of 18 <br />
