<br /> Intergovernmental Agreement
<br /> other rights under this Agreement. Waiver of any default or breach shall not be deemed
<br /> to be a waiver of any subsequent default or breach. Any waiver shall not be construed to
<br /> be a modification of the terms of this Agreement unless stated to be such in writing and
<br /> signed by personnel authorized to bind each of the parties.
<br /> 27. SEVERABILITY
<br /> If any term of condition of this Agreement is held invalid, such invalidity shall not affect
<br /> the validity of the other terms or conditions of this Agreement.
<br /> 28. ASSURANCES
<br /> The Contractor and all subcontractors agree that all activity pursuant to this Agreement
<br /> shall be in accordance with all applicable federal, state, and local laws, rules, and
<br /> regulations as they currently exist or as amended.
<br /> 29. NON-DISCRIMINATION
<br /> During the performance of this Agreement,the Contractor shall comply with federal and
<br /> state laws against discrimination. Non-discrimination requirements include,but are not
<br /> limited to:
<br /> Non-discrimination in Employment
<br /> • The Contractor shall not discriminate against any employee or applicant for employment
<br /> because they are a Vietnam-era veteran or disabled veteran, or because of race, color,
<br /> sex,religion,national origin, creed,marital status, age,presence of any sensory,mental,
<br /> or physical handicap, or because of an individual's sexual orientation.
<br /> • The Contractor shall take affirmative action to ensure that employees are employed and
<br /> treated during employment without discrimination because they are veterans or disabled
<br /> veterans or because of their race, color,religion, sex,national origin, creed,marital
<br /> status, age, the presence of any sensory,mental,physical handicap, or because of an
<br /> individual's sexual orientation. Such action shall include but not be limited to the
<br /> following: employment,hiring,upgrading,promotion, demotion,transfer,recruitment,
<br /> advertising, layoff termination,rates of pay, or other forms of compensation, selection
<br /> for training and participation in upward mobility programs, apprenticeships,volunteer
<br /> service, or board or advisory committee membership, and use of facilities.
<br /> • The Contractor agrees to post in conspicuous places available to employees and
<br /> applicants for employment,notices setting forth the provisions of this non-
<br /> discrimination clause.
<br /> • All solicitations, advertisements, or announcements for employees, volunteers, or board
<br /> or advisory committee members shall include reference to the Contractor policy of non-
<br /> discrimination and affirmative action. Classified advertisements shall include the initials
<br /> "EEOC/AA."All other solicitations, advertisements, or announcements shall include the
<br /> 3�- following statement: All qualified applicants shall receive consideration without regard
<br /> to race, color,religion, sex,national origin, creed,marital status, age, the presence of
