M <br />Memorandum of Understanding between City of Everett and <br />Washington Native Plant Society (WNPS) <br />This Memorandum of Understanding is a statement of principles and describes how the City of <br />Everett (COE) and the Washington Native Plant Society (WNPS) intend to perform with respect <br />to native plant restoration of a certain property owned by the City. <br />1. The purpose of this Memorandum is to define the responsibilities between the City and <br />WNPS for an urban forest restoration pilot project at Forest Park in 2008 and 2009. <br />2. Figure 1 shows the one (1) acre square site at Forest Park which the COE and the WNPS <br />have mutually agreed to be the subject area for the native plant restoration pilot project. <br />3. WNPS desires to provide urban forest restoration in an urban park in Snohomish County, <br />and has identified Forest Park for such a program. <br />4. WNPS desires to coordinate, lead and manage a pilot project, with funding provided by <br />WNPS and Snohomish County Surface Water Management, for native plant restoration in <br />an urban park setting. WNPS has identified Forest Park as its preferred site in Snohomish <br />County. The project will be conducted through a 10 week training class designed to <br />instruct stewards in proper management practices in urban forest restoration and invasive <br />plant removal. Once the 10 week class is completed, the restoration by the WNPS stewards <br />of the 1 acre site is expected to continue and be accomplished during the proceeding 12 <br />months, culminating in a minimum of 300 total stewardship hours toward the 1 acre site. <br />For all improvements, the WNPS will be primarily responsible for project development, <br />and the City will be in a supporting role as described in this Memorandum. Any <br />vegetation may be moved or eliminated at the sole discretion of the City. If WNPS fails to <br />provide the service as outlined in this agreement, the City may terminate this memorandum <br />with WNPS. <br />5. Changes to the Memorandum can be made either by mutual agreement between the parties <br />or unilaterally by the City. Most, if not all of the City parcels are Environmentally Sensitive Areas (ESAs), and both <br />parties acknowledge that ESA requirements and that the City's current Critical Area <br />116 Ordinance apply and must be followed. Both parties also agree that their actions must meet <br />all local, state, and federal regulations and that each party is solely responsible for <br />compliance of their actions and their installations with all local, state, and federal <br />regulations. <br />
