It is the specific intent of these regulations to place the obligation of complying <br /> with these regulations upon the permit applicant and any person owning, <br /> operating or controlling any building or structure within its scope. No provision <br /> nor term used in this Code is intended to impose any duty whatsoever upon the <br /> City or any of its officers or employees for whom the implementation or <br /> enforcement of this Code shall be discretionary and not mandatory. <br /> Nothing in this Code is intended to be nor shall be construed to create or form <br /> the basis for any liability on the part of the City or its officers, employees or <br /> agents, for any injury or damage resulting from the failure of a building to <br /> comply with the provisions of this Code, or by reason or in consequence of any <br /> inspection, notice, order, certificate, permission or approval authorized or <br /> issued or done in connection with the implementation or enforcement of this <br /> Code, or by reason of any action of the City related in any manner to the <br /> enforcement of this Code by its officers, employees or agents. <br /> Notwithstanding any language used in this Code, it is not the intent of the Code <br /> to create a duty and/or cause of action running to any individual or identifiable <br /> person but rather any duty is intended to run only to the general public. <br /> B. Section 110.1 of the 1994 Edition of the Uniform Mechanical Code is hereby <br /> amended by deleting: <br /> In order to hear and decide appeals of orders, decisions or determinations made <br /> by the Building Official relative to the application and interpretation of this <br /> code, there shall be and is hereby created a Board of Appeals consisting of <br /> members who are qualified by experience and training to pass upon matters <br /> pertaining to building construction and who are not employees of the <br /> jurisdiction. The Building Official shall be an ex officio member of and shall <br /> act as secretary to said Board but shall have no vote upon any matter before the <br /> Board. The Board of Appeals shall be appointed by the governing body and <br /> shall hold office at its pleasure. The Board shall adopt rules of procedure for <br /> conducting its business and shall render all decisions and findings in writing to <br /> the appellant with a duplicate copy to the Building Official. <br /> and inserting in its place: <br /> In order to hear and decide appeals of orders, decisions or determination made <br /> by the Building Official relative to the application and interpretation of this <br /> code, there shall be and is hereby created a Board of Review pursuant to <br /> Ordinance No. 351-75 as amended. Appeals from written orders of the <br /> Building Official must be filed within thirty (30) calendar days from the date of <br /> receipt of the written order by the aggrieved party.
