3. Application Documents for Binding Site Plans with a Previously Approved <br /> Site Plan <br /> An applicant for a Binding Site Plan with an approved site plan shall submit the <br /> following information on a fully completed application form: a legal description of <br /> the property, a vicinity map, declaration of ownership, title report, approved site <br /> plan, proposed Binding Site Plan or division, phasing plan, and other required <br /> application information as defined by the Planning and Community <br /> Development Application Packet. <br /> 4. Residential Condominium Binding Site Plans <br /> An applicant for a Residential Condominium Binding Site Plan is required to <br /> submit the Binding Site Plan map in accordance with Section III A 3. All lot lines <br /> at the time of recording the Binding Site Plan need not be shown if, prior to <br /> recording each condominium division, a new survey map is completed in <br /> accordance with Section III and lot corners are set. This division map at the <br /> time of recording must meet the requirements of Section III and be approved by <br /> the City. <br /> 5. Business. Commercial. and Industrial Binding Site Plans <br /> An applicant for a Business, Commercial or Industrial Binding Site Plan is <br /> required to submit the Binding Site Plan map in accordance with Section III A 2; <br /> this map must be approved by the City prior to recording. <br /> C. Review Process For Binding Site Plan <br /> 1. Action by the Planning and Community Development Department: <br /> If the Binding Site Plan application is complete and the fee is paid, the Planning <br /> and Community Development Department shall accept the application and <br /> conduct a review. <br /> 2. Action by Other City Departments: <br /> The Planning and Community Development Department will circulate copies of <br /> the proposed Binding Site Plan, site plan, and other required application <br /> information to other City departments with a request for recommendations. <br /> 3. Factors Considered by City Departments: <br /> The City shall review the proposed Binding Site Plan, site plan and other <br /> application information to determine whether it meets the following criteria: <br /> a. Comprehensive Plan - Whether the proposed Binding Site Plan, site plan <br /> and other application information proposed for development relates to all <br /> elements of the comprehensive plan; <br /> b. Zoning - Whether the proposed Binding Site Plan, site plan and other <br /> required application information meets the zoning regulations, except as <br /> permitted by this Ordinance; <br /> c. Physical Setting - Whether the Binding Site Plan, site plan and other <br /> required application information properly takes into account the <br /> topography, drainage, vegetation, soils and any other relevant physical <br /> elements of the site; <br /> 7 <br />
