A performance guarantee mechanism adequate to mitigate <br />INTERMEC's proportion of the mitigation measures identified in <br />the Study must be accepted by the City prior to issuance of <br />Building Permits. (SEPA Transportation Policies) <br />MITIGATION REQUIRED BY EXISTING CODES AND ORDINANCES <br />1. Development of the site must be in conformance with the <br />concomitant agreement which is Exhibit No. 2 of Ordinance No. <br />1436-88, attached, known as the Kenilworth Hills Office and <br />Industrial Park Rezone. (SEPA General Policies) <br />2. Development of more than the approximately 312,000 square feet in <br />Phase 1 and approximately 100,000 square feet in Phase 2, as <br />proposed in the project description above, will require a <br />subsequent SEPA review. (SEPA General Policies) <br />Full Standard half street improvements are required to 36th <br />Avenue W. per the traffic study and Ordinance 555-78. (SEPA <br />Transportation Policies) <br />Water - a 12" looped water main must be constructed by the <br />benefiting property owners from 36th Avenue W., through this <br />site, across Powder Mill Gulch, through Seaway Center's property, <br />and connecting to the main on Merrill Creek Parkway. For Phases <br />1 and 2 of INTERMEC the water main must be constructed to their <br />easterly property line, based on a phasing plan and in a location <br />approved by the City Engineer. The connection to the main on <br />36th Avenue W. should be between the two pressure reducing <br />valves. (SEPA Public Services Utility Policies) <br />Sewer - a connection to the sewer main parallel to Powder Mill <br />Gulch will be required unless the applicant can demonstrate that <br />the existing sewer mains north of this site have adequate <br />capacity to serve this site, the Fluke site and Bhend site under <br />ultimate land use conditions. Any required connection to Powder <br />Mill Gulch will ultimately require extension of the sewer to 36th <br />Avenue W. INTERMEC may make arrangements with other benefiting <br />property owners to share in the cost of this extension. A 20' <br />wide easement must be provided by INTERMEC to the City of Everett <br />for such sewer extension to their westerly property line prior to <br />occupancy of Phase 1.
