A. Shoreline Use Element (EMC 19.33D.050.A) <br /> 1. All e�erior lighting, including lighting of signs, shall be directed <br /> downward onto the site and away from other shoreline properties or <br /> nearby neighborhoods. (Regulation #1) <br /> 2. All shoreline de•.a!opment shall comply with the City's noise ordinance <br /> (Chapter 20.08 EMt;), both during and after construction. The City may <br /> require the Applicant to prepare noise studies to determine if a proposal <br /> is in con,�rmance with the ordinance. (Regulation #2) <br /> B. Cultural Resources Element (EMC 19.33D.060.A) <br /> 1. All Shoreline Permits shall contain provisions which require developers <br /> to immediately stop work and notify the City and the Tulalip Tribes if <br /> anything of possible archaeological interest is uncovered during <br /> excavations or development and consult a professional archaeologist to <br /> inspect and evaluate the site. Failure tu comply with this requirement <br /> i shall be considered a violation of the shoreline permit. (Regulation #1) <br /> C. Flood Hazard Reduction Element (EMC 19.33D.070.A) <br /> 1. All development in the Flood Fringe and Floodway overlay zones shall <br /> comply with EMC 19.30, as applicable. In addition, all develoFment <br /> loca�ed downriver from SR 529, shall be floodproofed in accordance with <br /> the provisions in EMC 19.30.040C, as applicable. (Regulation #2) <br /> D. Public Access Element (EMC 19.33D.OSO.A) <br /> 1. Public access shall be required to the extent allowed by !aw in the review <br /> of all shoreline substaniial development and conditional use permits. <br /> (Regulation #1) <br /> 2, Public access shall be provided on-site. (Regulation #2) <br /> E. Conservation Element (EMC 19.33D.090.A) <br /> 1. All development activities shall comply with the City's environmentally <br /> sensitive area ordinance, Chapter 37, in effect on March 21, 2001, and <br /> Planning Director Interpretation No. 2-2000, Interim Procedures, <br /> Endangered Species Act Listing for Chinook Saimon and Bull Trout, <br /> unless more stringent requirements are adopted by City Council <br /> subsequent to that date. (Regulation #1) <br /> 2. All developments shall comply with other local, state and federal <br /> regulations relating to critical areas, as applicable. (Regulation #2) <br /> 5 <br />
