Best available science shall be used in identifying, evaluating and <br /> mitigating impacts of development proposals. The City shall require <br /> sufficient geological, hydrological and biological studies to determine the <br /> impacts of the proposal. (See Chapter 37 and Planning Director <br /> Inte�aretation No. 2-2000 in Appendix A.) (Regulation #3) <br /> 4. All developments shall mitigate impacts to water quality using best <br /> available science. Comaliance with City stormwater regulations <br /> consistent with state stormwater regulations shall be required. Water <br /> quality monitoring during construction and operation may be required by <br /> the Planning and Community Development Director or Hearing Examiner <br /> on a project by project basis based upon specific characteristics of the <br /> proposal. (Regulation #7) <br /> 5. Buffers shall be maintained to eliminate invasive non-native species <br /> when practicable. (Regulation #21) <br /> 6. Whenever feasible, constr�ction staging areas shall be located outside <br /> of environmentally sensitive areas and buffers as defined in the SMP. <br /> (Regulation #3U) <br /> 7. Construction sites and on-going activities involved in the handling and <br /> storage of fuel, chemicals, oil and other substances with the pofential for <br /> spillage into adjacent waters shall have operational procedures to <br /> prevent and handle potential spills. In addition physicai structures which <br /> wo�ld contain any potential spilis shall also be provided. Procedures <br /> shall meet applicable local, state and federal requirements. (Regulation <br /> #34) <br /> 7 The SMP defines the proposed batch plant as an "inaustry". The project involves <br /> bringing on-site additional landfill as part of the development. While "Industry" and <br /> "Landfill" are permitted uses in the Urban-Mixed Use Environment, in order to secure a <br /> Shoreline Permit, the project must comply with the Specific Use Regulations of I <br /> Section 5.7 "Industry" and 6.6 "Landfill" of the SMP. These include: <br /> A. Industry (EMC 19.33D.160.A) <br /> 1. Non-water-dependent arid non-water•related uses, when permitted, shall <br /> provide significant public access per the requirements of Section <br /> 33D.080 of the Shoreline Master Program. Preference shall be given to <br /> public access uses and uses that provide substantial public enjoyment of <br /> the shoreline. Non-water-dependent and non-water-related uses shall <br /> preserve and enhance existing native st;oreline vegetation per the <br /> 6 <br />; _ _ ,. . . .. . __ . <br />
