The <br /> proposal is permitted in the Urban-Mixed Use Industrial shoreline designation. <br /> Flood hazards have been considered and adequate measures �re proposed to <br /> protect the site. Public access h�as been provided for in previous developments. <br /> Stormwater and process water systems wouid be designed to ensure <br /> contaminants do not enter surface or ground water. As noted in the previous set of Conclusions, the proposal is consistent with and <br /> complies with SEPA. <br /> DECISION <br /> Based upon the preceding Findings of Fact and Conclusions of Law, the ap�eal of the <br /> August 29, 2005, Mitigated Determination of Non-Significance is denied, and the <br /> Mitigated Determination of Non-Significance remains as issued. <br /> Based on the preceding Findings of Fact and Conclusions and testimony and <br /> evidence submitted at the public hearing, the request for approval of a Shoreline <br /> Substantial Development Permit and Special Property Use Permit for the construction <br /> of a ready-mix concrete batch plant with associated storage and retail facilities on <br /> property at 3640 — 34th Avenue NE, Everett, Wasliington ar� granted subject to tlie <br /> following conditions: <br /> 1. The proposed project must meet the policies and regulations of the City of <br /> Everett SMP and must be gererally consistent with the application materials <br /> presented to the City. Any modifications to this proposal ara subject to review by <br /> the Planning Director, who may approve the modification(�) as being insignificant <br /> or present the modification(s) to the Hearing Examiner wf�o may approve the <br /> proposed modification(s) or reopen the hearing to take ad i�r�onal public <br /> testimony. <br /> 18 <br />
