2. All exterior lighting shall be directed dc�wnward onto the site and away from other <br /> shoreline properties or environmentally sensitive site features. Lighting should <br /> be kept to a minimum (security lighting) when there is no activity in the yard. <br /> 3. All shoreline development shall comply with the City's noise ordinance (EMC <br /> 20.08), both during and after construction. <br /> 4. The Applicant must immediately stop work and notify the City and the Tulalip <br /> Tribes if anything of possible archaeological interest is uncovered during <br /> excavations or development and consult with a professional archaeologist who <br /> must inspect and evaluate the site. Failure to comply with this requirement shall <br /> be considered a violation of the Shoreline Permit. <br /> 5. This development must comply with air, stormwater and water quality <br /> regulations. The Applicant must provide the City with a spill prevention and <br /> remediation plan prior te the issuance of construction permits. Physical <br /> structures that contain any potential spills shall also be provided. Procedures <br /> shall meet applicable local, state, and federal requirements. ! <br /> 6. This development shall be floodproofed in accordance with the provisions in I <br /> EMC 19.30.040C, as applicable. These regulations require in part, that the first <br /> iloor of all structures must be two feet above the 100-year flood elevation, and , <br /> any equipment that may suffer flood damage, must also be protected by being <br /> placed two-feet above the 100-year flood elevation. A fully completed Floodplain <br /> Development Permit (including a National Flood Insurance Program Elevation <br /> Certificate) must be provided by the Applicant based on finished construction <br /> prior to the issuance of a certificate of occupancy. <br /> 7. Cedar Grove Composting must participate with surrounriing property owners to <br /> continue its existing trail to the south and/or west from its western terminus at the <br /> time the adjacent properties to the south and/or west are developed. <br /> 8. Install fencing and ESA signs along the wetland buffer. Record an <br /> "Environmentally Sensitive Area" covenant to protect the wetlands and their <br /> buffers. <br /> 9. All developments shall comply with other local, state and federal regulations <br /> relating to critical areas, as applicable. <br /> 10. Construction techniques should utilize Best Management Practices (BMP's) for <br /> erosion control in areas where 2ppropriate, such as those described in the <br /> Stormwater Management Manual for the Puget Sound Basin (Ecology 2U01). <br /> The specific sediment and erosion controls that will be utilized for this project wiil <br /> be determined prior to construction. <br /> 11.
