December 1, 1969 <br />The rogular meeting of the City of Everett Board of Adjustment was held at <br />7:39 n. ni. , Dec^_mhgr 1,• 1969, in the City Hall Council Charnbers, City hall, <br />Everett, Washington. <br />Air. Graff presided. Air. Cronin, Mr. Champion, Mr. Dickson and 1.1r. <br />Ingrain were Present. <br />The minutes of the November 3, 1069 Board of Adiustment inceting were read <br />and approved as read. <br />The Board continued the hearing on the application of j%1r. Carl Condit, 594 <br />51st Street for a varlaace and pormission to utilize a residential buildin, <br />site for a sin;jc family dwelling and to utilize a portion of said site as an <br />access road to an eiistin;; sawmill. <br />Aar. Condit had no additional testimony to add to that from the RTovember 3, 1969 <br />Board hearing. <br />After vit Bally vievAng the :subject property and evaluating the evidence and testi- <br />mony submitted, the 1'/;ard d tcr,nined that the requested variance would be <br />injurious to the public viclfare and propertles in the vicinity because as lon ; as <br />the use of the adjacent property for sawmill purposes continues the property <br />proposed for a variance would be inconsistent with the residential use proposed <br />by the applicant. <br />It was moved by Pair. Champion, seconded by Air. Cronin and carried unanimously <br />to deny the request; of Alr. Condit for the following reasons: <br />(11. There are no eacention,-I or es£ra-ordinary cir. cuznstances <br />apnlyin,; to the subject property which generally apply to other <br />properties in the vicinity. <br />(2i. The variance is not for the preservation of substantial property <br />rights which are enjoyed by others iu the same zone and vicinity. <br />A continuation on the application of Air. George Klein, 311 Alverson Blvd., <br />for a variance from tire ordinance and permission to utilize a tract of lvzd <br />as a buildin;; site (namely Lots 4 & 5, Bloc; 30, Plat of Everett, Division "S"; <br />and a request for perniis3ion to remove an existing single fainily d ,,cllin�rl within <br />a rnaximum period of five (5) years and to replace same. with another sin -le <br />family dwelling on Lots 6 & 7, dock 39, Plat of Everett, Division "S" <br />(313 Alverson Blvd. ). <br />Air. Vrri. Ingram, attorney for Mr. Klein, stated that Lots 4, 5, 6 & 7, <br />Block 39, Plat of Everett, Divinion "S` should be considered as one planning <br />unit, and the Board should consider the evidence from'lie prior hearin;;s <br />(January 31, 1969 & March 3, 190) relative to Lots 4 & 5, Block 89, Plat of <br />Everett, Division b"• . <br />Pair, Win. Ingra;n stated the members of the Board have viewed the condition of the <br />ezioting structure on I.ot3 5 & 6 and it is his contention the condition is such that <br />it need not be removed. Mr. h1 Eras stated that in his opinion the Doard may <br />order the removal of the structure but the faircat way is to permit the continuance <br />
