b. 6en�lusions: The proposed use of the subject property for <br />residential purposes is consistent with the Everett General Plan. <br />Criterion No. B: The need for the requested variance is not the result of a self- <br />created hardsh p. <br />a. Findings: The applicant has stated that the granting of the variance <br />would assist in the development of the lot due to the extraordinary <br />difficulties of building upon it, and that a reduction in the height of the <br />walis would rec'uce the functionality of the front yard (south side of <br />the property). Additionally, the applicant has stated that the height of <br />the subject retaining walls does not affect the stability of the buildings <br />foundation, nor would a reduc!;on in their height prevent the <br />completion of the residence on site. <br />The City has determined that the primary use of the walls is to <br />provide a more level front yard. If the height of the walls were <br />reduced to 36 inches in height in order to meet City code, the front <br />yard would still be useable, however it would be sloped rather than <br />level with the proposed structure. <br />b. Conclus(ons: Although there are some topographical differences on <br />site which have lent to a more difficult site development, the proposed <br />structure is not dependent upon the existing height of the walis. There <br />are no unique circumstances related to the subject property thai <br />prohibit the applicant from developing the lot. The desire of the <br />applicant to have two retaining walls each exceeding 36 inches in <br />height in order to create a more level front yard is the result of a self- <br />created hardship. <br />NOW, THEREFORE, the Board of Adjustment of the Ciry of Everett does hereby <br />order that the requested variance be DENIED. <br />The action of the Board of Adjustment in DENYING a variance shall be final and <br />conclusive, unless within twenty-one (21) days from the date of decision an <br />aggrieved person or persons obtains a writ of certiorari from the Superior Court of <br />Washington for Sr ohomish County for the purpose of review of the action taken. <br />DATED this 4th day of March, 2002. <br />� <br />� � <br />cUn <br />hairman, Board of Adjus t <br />� <br />
