Hoberts <br />Director <br />Kitty Wilhelm <br />3319 52nd Place SW <br />Everett, WA 98203 <br />RE: New construc:tion at 3321- 52"' Place SW <br />Dear Ms. Wilhelm: <br />This letter is in response to the letter received by the City of Everett Mayor's Office dated <br />April 3, 2002. Your letter expressed several concems regarding the construction of a <br />single-family residence at 3321-52ntl PL. SW. Below are a summary of the issues you <br />raised and the City's response at this time. <br />Potential earth movement due to new construction: The project w�s reviewed by <br />a geotechnical engineer, who made recommendations with regards .o the method of <br />construction and measures to take in order to reduce the impacts on the slope area. <br />The report stated "based on the competent soils that are believed to be from the core <br />of the s/ope, the absence of indications of past or current slope movement, the <br />absence of water seepage on the slope, and the mature trees and old growth stumps <br />on the slope, we consider the slope to be stab/e with respect to deep seated <br />movements" (Nelson Geotechincal Associates Inc., July 13, 2001). Based upon the <br />information provided in the geotechnical report the Planning Department approved a <br />steep slope modification, which allowed for the applicant to construct a single family <br />residence within the standard 25' buffer from a steep slope area. Also, the <br />geotechnical report was submitted to the City Building Department with the building <br />permit application, and a permit was issued based upon the recommendations made <br />within the report related to construction on �ite. <br />Vegetation removal in the Environmentally Sensitive Area (ESA): Section <br />19.37.040.D of the Everett Municipal Code defines slopes of 40% or greater as <br />environmentally sensitive areas. The northern portion of the subject property has <br />been established as an ESA, and covenants have been recorded for the site which <br />advise the property owner, Don Schwab, of the limilations of an ESA. The removal of <br />the trees and understory vegetation occurred prior to the request for permits and prior <br />to construction. The City Planning DepaRment has directed Mr. Schwab to replant <br />the hillside to mitigate impacts �f removal of the native vegetation from thf; slope. <br />• Runoff to the property below the subject site: One condition of building permit <br />approval for this site was that the roof top and driveway runoff be tightlined to the <br />stormsewer. At this time the City has not received any comments from the property <br />owner to the north (down slope) of the subject site regarding runoff or slope stability. <br />• Slope stability related to the digging of a ditch on site: In order to previde utilities <br />to the site it was necessary for Mr. Schwab to dig a ditch on his property to place the <br />CITY OF EVERETT �I3 <br />2930 Wetmore Avenue, Suite 700 • Everett, WA 98201 •(206) 259-8731 • Fax (206) 259-8742 <br />
