1. STAY OF ABATEMENT PROCEEDINGS. Code Compliance hereby stipulates <br /> to hold in abeyance any action to seek an order from the violations hearing examiner <br /> abating the hereindescribed code violations at 1509 — 23id Street in Everett, <br /> Washington, unless and until Surface breaches any term of this Stipulation. <br /> 2. REPAIRS. Surface hereby stipulates with the Code Compliance that he will <br /> complete the repairs at the property as set forth in Exhibit "A", which is attached and <br /> incorporated herein. <br /> 3. INSPE�CTIONS. SurFace hereby stipulates that he wiil not deny access and will <br /> allow unlimited access to Code Compliance representatives and/or other City <br /> representatives to inspect the building and premi�es located at 1509—23rd Street to <br /> ensure compliance with this stipulation, City codes and regulations. <br /> 4. 7ENANT REMOVAL. Surface hereby stipulates that he wiil remove any tenant <br /> from 1509—23'" Street who is destroying property, causing a nuisance, conducting an <br /> illegal business or engaging in drug-related activities at the property. No individual shall <br /> be allowed whose tenancy would constitute a direct threat to the health or safety of <br /> other individuals or whose tenancy would result in substantial physical damage to the <br /> property of others. <br /> 5. VIOLATION OR TERMINATION OF STIPULATION. In return for Code <br /> • Compliance holding in abeyance EMC Chapter 1.20 abatement action as described <br /> herein, upon violation or termination of this Stipulation Code Compliance may take <br /> action seeking entry of an Order abating the violations at the location, the issuance of <br /> which shall i�ot be contested. <br /> � <br /> 6. OTHER REMEDIES. Nothing herein shall prohibit the City from pursuing any <br /> other•legal recourse to which it is entitled or from pursuing abatement of any violations <br /> other than those set forth in Exhibit"A"to this stipulation. <br /> 7. SCOPE OF STIPULATION. This Stipulation is made specifically with respect to <br /> the code violations described in Exhibit "A" at 1509 — 23rd Street in Everett, <br /> Washington. Nothing herein shall be construed to affect any case, proceeding, appeal <br /> or other matter currently pending, or in any way modify any right or liability, civil or <br /> criminal, which may be in existence on the effective date of this Stipulation. This <br /> Stipulation shall not in any way limit or apply to any other proceedings, whether civii ar <br /> criminal in nature, against the property, Surface, or the tenants at the property. <br /> STIPULATION FOR REPAIRS AND 2 <br /> ABATEMENT OF NUISANCE <br />
