Replace Section 3 08 Non-Conforminq Work, with the followinq: A. If Sound Transit datermines that r:�aterial, equiarnent or workmanship oroposed for or incorporated in tli� Work is non-conforminq. Sound Transit shall have !he riqht to reiect such Work bv qivinq the Contractor written notice that such work is non-conformina Sound Transit at its option shall require the Contractor within a desiqnated time period as set forth bV Sound Transit to either (1) promptiv reGair, replace or correct ali Work not periormed in accordance with the Contract at no cost to Suund Transit� or (2) provide a sui!able corrective ac!ion plan at no cost to Sound Transit Sound Transit mav also provide a suitable corrective correctina all Work not performed in accordance with the Contract at no cost to Sound Transit Once accepted or directed bv Sound Transit the Contractor shall imqlemenl the corrective action olan at no cost to Sound Transit. If the corrective action plan as accepted or directed bv Sound Transit does not remedV the defective or non-conforminq Work the Contractor shall remain resoonsible for remedvinq the non-conforminq Work to Sound Transit's satisfaction and at no additional cost to Sound Transit The Contractor shall also be responsible for repairinq all propertv and work damaqed bv the Contractor at n� cost to Sound TransiL Under no circumstances shall the Contractor be entitled to additionai time or moneV for ihe correction of defective or non-conforminq work or (or the reuair of damaqed propertv.
