b. Use reasonable and practicable means to recruit and hire app�,;ntices to <br />achieve the twenty percent (20%) apprentice utilization goal. <br />c. Use reasonable and practicable means to recruit and hire minority and <br />women apprentices far the Project so that of the apprentice utilization <br />requirement percentage in this Section, the Contractor shall use women <br />and people of color to perform at least fifty percent (50°/a) of all first-year <br />apprentice hours in all trades and to perform at least thirty-three percent <br />(33%) of all apprentice hours worked. <br />d. Comply with the apprenticeship training standards for each trade/craft <br />classification used on the Projec[, as set forth by the Washington State <br />Departmert of Labor and Industries. <br />5. It is expected that an apprentice will normaliy begin training on the Project as <br />soon as feasible after start of work, utilizing the skill involved and remain on the <br />Project as long as training opportunities exist in the work classification or until the <br />completion of the training program. It is not required that all apprentices be <br />retained for the entire length of the Contract. <br />B. Changes to the Apprentice Utilization Requirement <br />If, during the term of the Contract, the Contractor determines that it will be unable <br />to meet the apprentice utilization identified in the Apprer,tice Utilization Plan as <br />accepted by Sound Transit, the Contractor may make a written request to Sound <br />Transit, to modify the Plan. The request shall include documentation of the <br />Contractor's affirmative efforts to use apprentices registered with the Washington <br />Slate Apprenticeship and Training Council ("SAC"), including copies of <br />correspondence between the Contractor and the SAC approved apprentice <br />programs, union locals, FAST Jobs Coalition, and others. The documents must <br />demonstrate that an adequate number of apprentices are not available to meet <br />the apprentice utilization percentage. <br />2. Sound Transit shall evaluate the request, and if appropriate, shall authorize <br />modification of the Apprentice Utilization Plan. If Sound Transit determines that a <br />modification is not justified, Sound Transit shall communicate the decision in <br />writing to the Contractor. <br />C. Apprentice Utilization Monitoring and Enforcement <br />Sound Transit or its designee shall verify the registration of each apprentice used <br />on the Contract with the Washington State Apprenticeship and Training Council. <br />2. Sound Transit or its designee shail monitor the apprentice utilization data <br />provided by the Contractor. In the event that the Contractor is deficient in the <br />use of apprentices, Sound Transit or its designee will meet with the Contractor to <br />discuss the reasons for the deficiency and help the Contractor develop a written <br />plan for meeting the goals. <br />3. Sound Transit may make routine visits to the Site for the purpose of confirming <br />the use of apprentices. The Contractor acknowledges that parties designated by <br />Sound Transit may make visits to the Site for the purpose of confirming the use <br />of apprentices.
