. � • � <br /> -45. Construction of all structures shall utilize Best Management practices for the site. A letter shall be <br /> provided by Gaffney Construction, or equivalent construction firm, stating that the method of <br /> construction utilized for the Phase II building is suitable within a five-foot setback from the edge of <br /> the stream buffer. <br /> 46. Prior to any clearing or grading activity o the site, a temporary construction fence must be placed <br /> along the environmentally sensitive area (ESA) buffer line to prevent encroachment during <br /> construction. A permanent fence must be constructed along the entire edge of the ESA buffer. The <br /> design of the fence should be split rail, or an aiternative approved by the Planning Department prier <br /> to the issuance of permits. City of Everett ESA signs must he placed along the fence at intervals ��f <br /> approximately 50 feet.,An ESA covenant must be recorded on site���hich designates the stream and <br /> buffer area as environmentally sensitive, and establishes the lim�tations of use of this area. <br /> 47. If Phase I construction and occupancy is completed prior to building permit application for Phase II, <br /> then a fence will need to be provided between the developed and undeveloped area. <br /> 48. This land use permit shall terminate if a complete b�ilding permit application has not been applied <br /> for within 18 months (or, with an extension, 24 months), except where a time limit on the land use <br /> permit is othenvise established under federal or state law, city ordinance, or an executed <br /> development agreement. If a compiete building permit is not applied for both Phase I and Phase II <br /> within the timeframe described above, then one of the following alternatives will be applied to the <br /> portion of the project, which has not been vested. <br /> • If the pro�osal is submitted with no change from the original SEPA review then a Review <br /> Process II review will be completed, after whir.h a Notice of Adoption will be issued. <br /> • If the p�oposal is submitted and a minor change ;s proposed from the original SEPA <br /> review, then a SEPA addendum will be issued. <br /> • If the proposal is submitted and a major change is proposed from the original SEPA <br /> review, then a new SEPA application will need to be made and reviewed upon its own <br /> merit. The determination as to whether a change is minor or major in nature will be made <br /> after a review has been completed by City officials and other agencies with jurisdiction. <br /> 49. The following arteriais and highways are designated as "gateways corridors" for which particular <br /> attention will be given to the design and maintenance of public improvements and the application of <br /> standards to development of abutting properties: <br /> Broadway north of 41 st Street, West Marine View Drive, Pacific Avenue, Hewitt Avenue, <br /> Everett Avenue, Rucker Avenue 6etween 19th Street and 43rd Street, Colby Avenue, <br /> Mukilteo Blvd, 41 st Street, Evergreen Way, 19th Avenue SE, 128th— 132nd Street corridor, <br /> SR 526, and Interstate 5. <br /> 50. The design and implementation of public improvement projects undertaken in any of the designated <br /> gateway corridors identified above shall include aesthetic as weil as functional considerations in <br /> order to support and enhance the visual quality and character of the city. Such aesthetic <br /> considerations shall include, but not be limited to, appropriate street trees and piantings, utility <br /> structures such as street lighting and traffic control devices, public right-of-way signs, retaining walls <br /> and pedestrian safety rails, bicycle lanes, transit benches and shelters, and other right-of-way <br /> improvements as appropriate. <br /> 9 <br />
