Any violation of the lease <br />restrictions of this subparagraph which are included in the <br />tenant leases or rental agreement shall constitute a breach of <br />the lease. The lease restrictions of this subparagraph shall <br />continue to apply in the event the Project is condominiumized. <br />Inclusion of the lease restrictions of this paragraph in tenant <br />leases or rental agreements and/or condominium documents, if <br />any, shall be included in the recorded Declaration of Covenants <br />substantially in the form of Exhibit B. <br />9. Walkway Maintenance. Bay Ridge agrees to perpetually <br />maintain in reasonable condition the pedestrian walkway <br />connecting the Project site to 24th Street. A covenant <br />specifying this responsibility shall be executed and recorded <br />prior to the issuance of occupancy permits. The pedestrian <br />walkway shall be maintained to restrict access by motorized <br />vehicles to the extent Bay Ridge can control its access point. <br />10. Landscanina Plan Finalization. Prior to finalizing its <br />proposed landscaping plan and submittal of the same to the City, <br />Bay Ridge shall provide three complete copies of the proposed <br />landscaping plan to SLAC which will cause that lanc'.scaping plan <br />to be reviewed by its steering committee or other designated <br />group. SLAC shall provide any comments it has on the <br />landscaping plan, in writing, to the City within seven (7) days <br />STIPULATED SETTLEMENT AGREEMENT - 8 ANDERSON HUNTER <br />,J )O!
