Bay Ridge shall meet with representatives of SLAG to <br />discuss any issues, comments or suggestions that SLAC has with <br />respect to the landscaping plan. After providing its comments <br />to Bay Ridge, SLAC may provide those comments to the City of <br />Everett which will have the decision -making authority with <br />respect to the final landscaping plan. The landscaping plan <br />shall be consistent with the tree retention and replacement <br />requirements of this agreement. <br />11. Bay Ridge agrees to execute a covenant restricting <br />vehicular access from the project to 23rd Drive unless such <br />vehicular access was imposed on the project property in the <br />future by the City or other regulatory authority. Bay Ridge <br />shall not directly or indirectly promote such additional access <br />point. The covenant to be executed shall be in the form of <br />Exhibit B. <br />12. Miscellaneous Issues. Bay Ridge agrees to pay the cost <br />of paving five (5) parking spaces at City Beach Park, located at <br />the intersection of Silver Lake Road, 112th S.E. and Interstate <br />5 at the time the City is prepared to pave the parking spaces in <br />the park. <br />Bay Ridge agrees to maintain a fifty (50) foot setback <br />area between the Project property line and any three (3) story <br />structures.
