SLAC agrees that if a further administrative <br />action, appeal or court action is brought directly or indirectly <br />by SLAC or the individual signators hereto prior to, during or <br />after development of the Project, this agreement shall be <br />voidable at the election of Bay Ridge; provided, however, <br />nothing herein contained shall be construed to prevent SLAC from <br />bringing any action, including an action for injunctive relief <br />or specific performance which may be necessary as a result of a <br />breach of this agreement by Bay Ridge, contest future local <br />improvement districts that might involve the subject property or <br />challenge revisions to the shoreline substantial development <br />permit (other than those revisions necessitated by this <br />Agreement). Further, nothing in this agreement is intended to <br />restrict SLAC's right to advocate as a policy matter that <br />further development around Silver Lake is not appropriate. <br />15. Assignment. Bay Ridge agrees that, the event Bay Ridge <br />sells, assigns or otherwise conveys Bay Ridge's interest in the <br />shoreline substantial development permit and the determination <br />of non -significance for the Project, the terms of this agreement <br />and covenant shall be binding upon any successor or assign of <br />Bay Ridge who proceeds with development of the Project under Bay <br />Ridge's shoreline substantial development permit and DNS; <br />provided, however, the terms of this agreement shall not be <br />binding upon any party or entity who files new development <br />applications and requests new environmental determinations for <br />STIPULATED SETTLEMENT AGREEMENT - 11 AN OERSONC HUNTER <br />. rwrtss�oen acw ¢c cow.olunon <br />mc.r.o�c uo.� a.a sH. <br />0 <br />
