In addition, the Applicant <br /> requested clarification of the responsibility for the <br /> costs of connecting the pathway trail from the <br /> termination point at the restaurant to the property <br /> north of the subject property. (Cole testimony) <br /> CONCLUSIONS <br /> 1. The application is for the approval of a Shoreline � <br /> Substantial Development Permit per City Ordinance <br /> #723-80, as amended, for development of 11822 19th <br /> Avenue S.E. between 116th Street S.E, and 120th Street <br /> S,E. , in the City of Everett, Washfngton. The <br /> development includes demolition of an old resort <br /> building and the construction of a 25,600 square foot <br /> office building and a 5,500 square foot restaurant <br /> building and development of 137 parking spaces in <br /> conjunction with the buildings. An existing over-water <br /> building will also be restored. <br /> 2. A Shoreline Substantial Development Permit is required <br /> per RCW 90.58.140 (2) . A Shoreline Substantial <br /> Development Permit is required because: <br /> A. The nroject's close proximity to Silver Lake; <br /> �. The development will occur on a shoreline as <br /> defined in RCW 90.58.030; and, <br /> C. The development is a substantial development as <br /> defined in RCW 90.58.030. <br /> 3. 4�he proposed development is a substantial development as <br /> • defined in the Shoreline Mant.gement Act of 1971. Silver <br /> Lake is a shoreline recognized under the terms of the � <br /> Shore.line Management Act of 1971. Accordingly, the <br /> ' Applicant must obtain a Shoreline Substantial <br /> Development Permit for the proposed development of the <br /> site. <br /> 4. � Ordinance #1122-85, Section 7, of the City of Everett, <br /> establishes the criteria for the issuance of Shoreline <br /> Substantial Development Permits.
