The Everett Shoreline Master Program (in this <br /> , situation, the Snohomish County Master Program) ; <br /> and <br /> D. The State Environmental Policy Act. <br /> With conditions of approval as set forth in this <br /> document, the proposed development of the site will <br /> ' satisfy the criteria of these acts. <br /> 5. The City of Everett Ordinance #1122-85, Section 10 (2) , � <br /> grants the Everett Hearing Examiner the jurisdictional <br /> authority to hold a hearing and to make a decision on <br /> the Shoreline Substantial Development Per.mit request. <br /> Ordinance $1122-85, Section 12 (C) , grants the Everett <br /> Hearing Examiner authority to attach conditions, <br /> modifications, and/or restrictions on the location, <br /> characcer or other features of the proposed development <br /> that are necessary to make the permit and the <br /> development compatible with the criteria as set forth in <br /> Section 7 of Ordinance #1122-85. <br /> 6. The subject property is desi5r�ated in the Snohomish <br /> County Master Program as Urban. The proposed <br /> development satisfies the goals, policies and criteria <br /> of Urban designations. <br /> 7. Public access is required to Silver Lake. The <br /> continuous public pathway along the shoreline from the <br /> south property line to the north property line is <br /> n�ecessary. <br /> 8. On-site is an existing building on pilings which extend <br /> into Silver Lake. It is the intent of the Applicant to <br /> restore this building and to use it as a conference and <br /> meeting room. This building on piers is a permitted use <br /> in an Urban Environment. � <br /> 9. The r�storation of the existing building on piling on a <br /> pier in Silver Lake is permitted in an Urban Environment. <br /> 10. The proposed use is consistent with the zoning <br /> designation of B-2 (B) . <br />
