CONCLUSIONS <br />1. The appeal is an appeal of the issuance of a Mitigated Determination of <br />Non -Significance issued by the Planning Director on September. 14, 1987. <br />2. The issues appealed were drainage, animals, noise, light and glare, <br />traffic and air emissions, public services imracts, and a requirement <br />for the developer to sign a L.I.D. covenant for street improvements to <br />19th Ave. S.E. <br />3. The appellant must prove that the City erred in issuing the <br />Determination of Non -Significance on this project. <br />4. The conditions placed in the DNS regarding stormwater drainage <br />(conditions 1, 2, 3 and 7) are adequate to mitigate the significant <br />impacts of the proposal. <br />Staff recommends that the City Council revise the DNS as requested by <br />the Department of Wildlife to make more clear the City's intention that <br />the wetlands be incorporated into the stormwater system, that is, <br />change condition 3 to read, <br />"Prior to the issuance of any permits, a detailed drainage plan must be <br />reviewed and approved by the City. On-site detention must be provided <br />for all storm events. To the extent feasible, the developer should <br />maximize detention in the wetland areas to provide more efficient <br />detention in one and two year storms and 25 and 50 year storms. <br />Drainage must be routed so that it does not run off onto adjacent <br />properties. If possible, drainage should be handled in open swales." <br />5. Although wildlife activity on the site will be reduced, the two most <br />significant wildlife habitat areas on the site will be maintained to <br />mitigate impacts on wildlife habitat. The resulting development will <br />not have a significant adverse impact on wildlife habitat. <br />6. Although increased residential use will increase noise levels on the <br />site, the noise levels would be typical of noise associated with <br />multiple family development and would be consistent with the City's <br />SEPA policy which states: <br />To encourage development practices consistent with the noise control <br />ordinance, Ordinance No. 534-78 or as such may be amended or <br />superseded. To minimize the exposure of citizens to the harmful <br />physiological and psychological effects of excessive noise; to control <br />the level of noise in a manner which promotes commerce; the use, value, <br />and enjoyment of property; sleep and repose; and the quality of the <br />environment. <br />7. The requirement to direct the lights away from single family areas and <br />the recommendation that lighting be a minimum of one to two foot <br />candles are not contradictory.
