121l Fencing, berming and dense evergreen buffer must be provided around the <br />-...i North, South and East boundary of the site except in those areas wh.. .e <br />the preservation of existing tree cover and wetland protection dictates <br />that such a buffer not be provided and those areas where it is not <br />provided will be at the determination of the City staff. Otherwise it <br />will be provided along the entire north, south and east boundary. <br />3. The Applicant must save as much of the natural vegetation as possible <br />on the site, especially respecting the ebergreen tree cover and will <br />defer to staff as to which of those vegetation areas need to be <br />preserved. <br />4. The Applicant must provide wetland enhancement to diversify and <br />increase the habitat value as allowed by the resource agencies with <br />jurisdiction over such wetland areas. <br />5. The Applicant must provide and record a covenant on the r.roperty <br />guaranteeing maintenance of oil and water separators with provisions <br />for the right of City enforcement of those binding on the owner, Metco, <br />and all future heirs, successors and assigns. <br />6. The Applicant must proceed with frontage improvements along the <br />frontage of 19th Avenue SE as identified in the staff recommendation <br />without the benefit of an LID. <br />7. The Applicant must record a LID non -protest agreement binding Metco and <br />all future owners, successors and assigns to not protest the formation <br />of any local improvement district for the improvements to 19th Avenue <br />SE as set forth in the staff recommendation. <br />S. The Applicant must provide written certification from the Corps of <br />Engineers that no permit is required under the 404 regulation before <br />building permit issuance provided that the Corps does not require that <br />permit for any enhancement program approved by any other resource <br />agenciec. <br />MITIGATION OF ADVERSE IMPACTS BY SEPA <br />1. Four wetland areas exist on the site. The two wetlands on the northern <br />portion of the site must be maintained in order to maintain the quality <br />of water flowing into Silver Lake, to provide stormwater detention, and <br />to provide wildlife habitat. The boundary of the 2 wetland areas must <br />be staked by the applicant and approved by the Department of ecology. <br />In addition, a twenty-five foot buffer area must be maintained around <br />the wetland area. Prior to any construction activity on the site, the <br />boundary of the buffer areas must be roped off and no activity is to <br />occur within the areas unless approved by the Planning Department. <br />The two wetland areas should be incorporated into the stormwater <br />detention system. An easement will be required from the property owner <br />to the northeast for construction of a detention system if the off-site <br />wetland area is impacted. <br />-2- <br />
