il. Building setbacks must be a minimum of 10 feet in the rear yard. <br />Building height shall be a maximum of 50 feet. <br />12. Landscaping must be provided per Section 35 of the Zoning Code. <br />At a minimum this must include the following: <br />a. All landscaping stipulated under Condition #3.b. and 3.c. <br />of this MDNS, as stated under "Mitigation of Adverse Impacts <br />by SEPA." <br />b. A landscape strip a minimum of 5 feet wide must be provided <br />along the west, north, and south property lines adjacent to <br />the parking lot. This area shall be planted with Type III <br />landscaping. <br />C. 1,680 square feet of landscaping shall be provided in the <br />interior of the parking lot for the 64 parking stalls <br />proposed (assuming approval of the requested variance for <br />parking). Landscaping must be provided per Section•35.080E. <br />of the Zoning Code. <br />d. Prior to issuance of any permits, landscaping plans must be <br />reviewed and approved by the Planning Department per Section <br />35.100 of the Zoning Code. The landscaping plan must show <br />location of required grassy swales, rockeries and retaining <br />walls, and grading at 5 foot intervals. Irrigation systems <br />must be provided in all landscaped areas per Section 35.130 <br />of the Zoning Code. A 2-year maintenance assurance device <br />must be provided for the landscaping per Section 35.130 B of <br />the Zoning Code. <br />13. A portable fire extinguisher with a minimum UL rating of 2A must <br />be provided within 75 feet travel distance of all portions of <br />each building on each floor during construction and prior to <br />occupancy. Portable fire protection must be provided throughout <br />the building as required by Article 10 of the Uniform Fire Code <br />prior to issuance of the Certificate of Occupancy. <br />14. The building must be sprinklered in accordance with NFPA 13, or <br />UBC standard 38-1. <br />15. where the assigned occupant load exceed 300 persons, a manual or <br />automatic fire alarm system must be installed in accordance with <br />Uniform Fire Code Standard 14-1. <br />16. Fire lanes must be established and must be in compliance with <br />City Ordinance (Everett Municipal Code 46.44). <br />17. Fire lanes must be provided as required in Everett Municipal <br />Code 4.6.44.
